APPLICATION FOR AMENDMENT TO OPERATING LICENSE Pursuant to Section 50.90 of the regulations of the Nuclear Regulatory Commission, the Power Authority of the State of New York, as holder of Facility Operating License No. DPR-59, hereby applies for an Amendment to the Technical Specifications contained in Appendix B of this license.

The proposed changes to the James A. FitzPatrick Technical Specifications delete all non-radiological specification sections and references in Appendix B. These deletions are being proposed at the request of the Nuclear Regulatory Commission, pursuant to the Federal Water Pollution Act Amendments of 1972. Henceforth, non-radiological environmental regulatory requirements will be applied and enforced under the FitzPatrick pollution discharge permit granted by New York State.

The proposed changes to the Technical Specifications are Attachment I to this application. The Safety Evaluation for this change is included as Attachment II.
