STATE 51!T ON DIA3LO bill Denneen

!/.any people have asked me why I committed a " crime" at the This is an attempted response.

Diablo demonstration of August 6th.

Nuremberr Princirle:

There are higher moral laws which at times may contradict The Nuremberg Principle states that "indiv-current local laws.iduals have international duties which tran'scen obligations of obedience imposed by the individual state."

This is based on the post t.Jorld War II trials in GermanyMany claimed which detit with the Holocaust responsibilities.

thct they were just following orders.

Civil Disobedience:

Acts of civil disobedience have been basic to the successaxf American democracy, e.g., the Boston Tea Party, wo:aen's right to vote, birth control clinics, defense of the whales and other wild-Henry etc.

life, the anti-war movement, Sanger have been my inspirstional exampics of persons who acted in conscience to oppose existing state and nctional laws.

The Crime:

Basically the '* crime".with which I was charged consisted of crossing a blue line painted on the road about twenty yards out-It is interesting to side the entrance gate to Diablo Canyon.

note that last year I was inside this blue line area for about eight hours carrying an anti-nuclear placard and was n it is not an act of trespass to cross a blue line painted on the road.

l I am The solcalled " crime" was a symbolic one, a message.could go to the sure that anyone, anytime, for the same length of time and nothing would happen.

Guestions that FG&E Has Avoided:

If nuclecr fissien is so safe, why isn't Diablo it does carry is 1.

Insurance:

fully insured?

The limited insurcnce that(Frice-Anderson Ac't).

subsidized by the federal government Almost 70% of the heat produced by this plant At a time of energy shortages and 2.

Desalinization:

will be so-called waste hest.why isn't this heat used for desalinization?

severe drought,

(cone!d) 3 Jecommissioning:

What are the clans for destroying this plant in 25-30 years?

4.

Uaste:

What will haccen to the radioactive vaste so that future generations will not'be burdened with this awful legacy? In 1976, PC&E contributed $500,000 to the defeat of Froposition 15 The proposition would have placed,a moratorium on new fission plants until a solution to the waste rroblem could be found.

The half million dollars would have been better spent finding an answer to the problem rather than avoiding it.

Biased Information:

FG&E is supposedly dedicated to the public interest yet it main-tains an elaborate and expensive "Huclear Informaticn Center" to pro-mote biased, pro-nuclear information.

If the Center presented both sides of the issue, I probably would not have committed civil dis-obedience.

The issue of*using nuclear fission with its death-dealing by-products is too ie.portant for anything less than the full and com-plete facts available to eve'rybody openly and honestly.

Alternatives:

he don't need dangerous.and expensive nuclear plants to supply electricity.

Clean renewable energ, sources are available today. By retro-fitting buildings, far more energy could be saved by the year 1990 than even a vhstly accelerated nuclear program could produce.

Redesigning our buildings to be energy efficient could save 4 to 6 billion barrels of oil per year by 1990, in addition to creating 2 to 3 million jobs and being 6 to 10 times less expensive than pro-ducing an equivalent amount of energy.

The Demonstrators:

Most of the 500 demonstrators were alert, responsible and edu-cated people in their twenties, although the age range was,14-70.

There were students, teachers, construction workers, farmers, retired people, and even a Catholic nun.

I felt proud to be associated with such a fine group of people. (As for myself, I have lived in the same house'for 15 years, worked for the same employar for 18 years, and have passed the half-century mark.)

Since the demonstration, I have talked with many (about 60)

San Luis residents about the demonstration.

Three were opposed; the rest were supportive.

Ten plan to demonstrate next year!

Punishment:

The courts a.e over-reacting and over-punishing.

They have the false idea that by increasing the punishment tPe aemonstrations will stop.

Viet Nam showed otheruice.

I committed civil disobedience vith the full knowledge that punishment would follow.

Six months in jail vith loss'of freedom would be very difficult for me, but if that is the punishment, I am ready.

I am not on trial----nuclear fission is.
