Suoject: Drop-In Meeting Record This letter documents, for record purposes, the October 11, 1990 drop-in meeting discussion between you and Messrs. T. Martin, W. Kane, and E. McCabe of NRC Region I.

The meeting was held at your request to discuss refueling outage progress, recent allegations, and NRC inspections. During the meeting, the following were 16n-tified:

Your view of the success of the outage.

Recent State of Vermont dissemination of information on allegations about Vermont Yankee and your conclusion that those allegations did not represent a quality program at Vermont Yankee, including your conclusion that the spent fuel pool equipment was operable.

Your view that a meeting between your staff and the NRC Region I staff may be needed to assure that full informati:n has been provided to the NRC in regard to NRC inspections related to the recent allegations, including the allegations involving waste oil burning and harassment / intimidation of QC inspectors.

The NRC position that, when the NRC becomes aware of a violation, enforcement action is taken in accordance with the enforcement policy. regardless of '

when the violation occurred. However, that does not mean that violations are cited for conditions which existed before the requirements involved were effective.

Your view that violations cited as a result of, or in conjunction with, inspection of an allegation may be construed by the public as substantiation of the allegation, even if the violation is unassociated with the allegation.

• Vermont Yankee Nuclear Power 2 NOV 2 01990 Corporation requirements should be cited in accordance with the NRC enforcement policy, and that unwarranted linkage of violations by the NRC should be avoided to the extent practicable.

We acknowledge your concerns and appreciate you taking the time to bring them to our attention. We also understand that additional meetings may be desired by your staff regarding overall plant performance and system operability evalu-ations. These should be coordinated with the senior resident inspector (Mr. H. Eichenholz) or the project section chief (Mr. J. Rogge).
