This is an aff.irmation/ discussion session and we 4 will ask the Secretary to walk us through the items. ~ MR. H0YLE: All right, Mr. Chairman. The first 5 item is'SECY-82-196, proposed rulemaking requiring fitness 6 ~ 'g., p for duty for personnel with unescorted access to protected 7 areas. 8 In this paper, the Commission is asked to approve a 9 proposed rule that would require commercial and industrial to facilities licensed under 50.22 to establish and implement Procedures to assure that personnel with unescorted access 11 to protected areas are not under the influence of drugs or alcohol or are not otherwise unfit for duty due to mental or 13 jp temporary physical impairments. 14 All of the Commissioners have approved the proposed 15 rule. Commissioner Gilinsky has suggested that comment be 16 obtained on two other issues. One is whether it should be n k 17 applied to NRC personnel on whether there should be specific 2 blood alcohol level limits. 18 COMMISSIONER GILINSKY: NRC personnel as well. 'j 19 p MR. H0YLE: Excuse me. I meant to say NRC personnel. 1: 20 l3 CHAIRMAN PALLADIN0: What do you mean? Get comments? 21 g MR. H0YLE: From the members of the public as they u ~ 22 are commenting on -- and the industry -- as they are commenting 23 on the rule. COMMISSIONER GILINSKY: I meant at the sites, not 24 (7 here and in Bethesda. (Laughter.)

g 3 1 CHAIRMAN P.ALLADINO: I wonder. if we should not deal 2 (gg with the NRC problem separately and not make it a part of this. 3 COMMISSIONER ROBERTS: Do we have a problem? 4 (Laughter.) ~ CHAIRMAN PALLADIN0: Our rules with regard to conduct 5 of our own people.it seems like should be treated separately. 6 COMMISSIONER GILINSKY: But the question is who gets 7 in the gate at a reactor site. 8 MR. H0YLE: Commissioner Ahearne has a related 9 request that will be sent to the staff which asks them to 10 provide information on how NRC personnel are checked prior to being granted unescorted access in protected areas. Perhaps 11 that information could shed some light on that subject. CHAIRMAN PALLADINO: Where does that leave us?

The question is, I believe, 16 Commissioner Gilinsky would ask a comment on another issue, { 17 perhaps only the one now, whether there should be specific blood alcohol level limits. 18 COMMISSIONER GILINSKY: I would ask for comment on i 19 i both, but it is up to the Commissioners. 20 2 CHAIRMAN PALLADIN0: I would like to know how the NRC J h people are going to be handled. COMMISSIONER AHEARNE: I am puzzled by what John. 4 said b'ecause my understanding was that SECY had already checked with'the offices and we had said that we did not want' ~ "~ ~ 6 ~ to go out for c'omment on those two pieces and so Vic had said that then he would ask that the Federal Register Notice be 8 modified to ask for comment in his name. 9 CHAIRMAN PALLADINO: That would be all right. MR. H0YLE: Yes, sir. in You are being i.ad to affirm approval of the proposed rule. 12 (Chorus of unanimous ayes.) 13 MR. H0YLE: The second item is 82-230. This is = =. I4 a paper regarding an application for a stay on San Onofre 2 15 Low-Power Operating License and review of ALAB-673. 16 The Commission is being asked to approve an order denying the application for stay and declining to take review g l. of the Appeal Board decision. Ii 18 l The Chairman, Commissioners Ahearne, Roberts and j 19 Asselstine have approved the order with the revision by OGC. g 20 J have Commissioner Gilinsky's vote as yet. I wo'uld mention that 10 Commissioner Roberts would have preferred to delete a footnote which the rest of you' have not agreed to delete. 11 COMMISSIONER GILINSKY: I am approving the result 12 and just attaching my own comment. You 4 have a'lso approved a Staff Requirements memo directing the 5 staff to revise the final rule and to expedite those revisions 6 back to the Commission. 7 Commissioner Roberts does not agree with the inclusion 8 of two of the items in 'the Staff Requirements memo. A notice of proposed rulemaking was published in the FEDEPAL REGISTER ~ on January 20, 1982 (47 FR 2876). The proposed rule contained a new imple - mentation schedule which would supersede the June 30 deadline in the tech-nical specifications or license conditions of operating plants. In addition, the proposed rule in'cluded a requirement that licensees of operating plants l submit justification for continued operation whi.le qualification efforts are J l still underway', but it was noted that, if these plant-specific justifications were voluntarily submitted and evaluated by the staff prior to publication of a final rule, this 5quirement wouid be deleted.
