REPORT OF THE DEPARTMENT OF JUSTICE - NOVEMBER, 1978 Pursuant to the order of the Atomic Safety and Licensing Board of June 21, 1978, the Department of Justice (Department) submits this report on the progress made in completing discovery during the month of November.

During the mo' nth of November, the Department received all volemes of transcript for the related private antitrust action, West Texas Utilities comoany and Central Power and Light Company v. Texas Electric Service Company and Houston Lighting & Power Company, U.S. Dist.~Ct. Case No. ,

CA3-76-063F. These transcripts are currently being reviewed.

In addition, the Department has received, and is reviewing, all the documents offered as exhibits in that proceeding.

By letter dated October 11, 1978, counsel for Texas a

(_' Utilities Generating Company indicated that TU was withhold-ing as privileged certain documents requested by the Depart-ment in its review of TU discovery materials. The Depart-ment shortly thereafter requested of Washington counsel for TU that a descriptive list of the documents in question, containing sufficient information so that the claims of i privilege might be assessed, be provided. As of this date, this requested information has not yet been made available to the Department.

Throughout the entire month of November, the Depart-ment continued its process of reviewing discovery materials already received.

Please note that during the 1onth of November a new
