{{#Wiki_filter:- o P v APPENDIX A NOTICE OF VIOLATION l Vermont Yankee Nuclear Power Corporation Docket No. 50-271 Vermont Yankee Nuclear Power Station License No. OPR-28 As a result of the inspection conducted on August 29-31, 1990, and in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy 1990), the following violations were identified: A. Part 73.55(g)(4) of Title 10, Code of Federal Regulations states, in part, that the security program shall be reviewed at least every 12 months. The review shall include a review and audit of security procedures and practices.... The NRC-approved Physical Security Plan for the Vermont Yankee plant, Chapter 12.6, " Quality Assurance," states that the Yankee Atomic Electric Company Quality Assurance Plan addresses the security plan and procedures under Chapter 18 - Audits. Audits to assure continued quality assurance are performed in accordance with Chapter 18 of the Yankee Operational Quality Assurance Manual, YOQAP-1-A. Additionally, these audits will + assess, on an annual basis, the potential impact of the Physical Security Plan and security procedures on plant and personnel safety. In addition, Chapter 14.1 of the Physical Security Plan, " Compliance Audits " states i that an annual audit is performed by the Operational Quality Assurance Department (0QAD) of Yankee Nuclear Services Division (YNSD) to ensure compliance with the Vermont Yankee Security Plan and implementing security procedures. Chapter 14.1 also specifies that a written audit report is l prepared and submitted to plant management, and that this audit program is conducted in accordance with OQAD procedures. Contrary to the above, the licensee failed to audit the practices and procedures' utilized for pre-employment screening conducted by'its contractors and union Business Agents on an annual basis to ensure compliance with the Vermont Yankee Security Plan and implementing procedures. This is a Severity level IV Violation (Supplement III). B. Appendix A Appendix G lists, in Paragraph I, certain events required to be reported within one hour of discovery, followed by a written report within 30 days, including: (b) an actual entry of an unauthorized person into a protected area, (c) any failure, degradation, or the discovered vulnerability in a safeguards system that could allow unauthorized or undetected access to a protected area, material access area, controlleo access area, vital area or transport for which compensatory measures have not been employed. Contrary to the above, on August 22, 1990, three instances were identified by the licensee where contractor personnel who did not meet the access authorization criteria had been granted unescorted access to the station's protected area, yet the licensee did not notify the NRC Operations Center within one hour of any of the instances. This is a Severity level IV Violation. Pursuant to the provisions of 10 CFR 2.201, Vermont Yankee Nuclear Power Corporation is hereby required to submit to this office within 30 days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
