i Your letter of November 27, 1978 to the Atomic Safety and Licensing Board raises several questions which I will try to answer.

Your letter of October 3, was responded to by Mr. Charles A.

Barth, Esq. attorney for the Nuclear Regulatory Commission Staff by his letter of November 6, 1978. For your con-venience, I am attaching a copy of his letter.

l I do not know if it is possible for any person employed by i the Nuclear Regulatory Commission to advise you fully concerning the legal form and procedures to follow to i

[] satisfy all your particular requirements in this pro-v ceeding. However my experience has been that the attorneys for the NRC Staff have been very courteous and helpful in advising potential intervenors . I am requesting the NRC

Staff counsel to provide you with a copy of NRC Rules of

! Practice and to answer specific procedural questions you l may have. Please direct 'all future questions concerning procedural matters to these attorneys, not to the Board.

, The Board may be of very limited help to you at this _

point because it is our responsibility to remain impartial in deciding the issue befcre us . ---

The Atomic Safety and Licensing Board has not ruled upon i the request to intervene dated November 7, 1978. Your l letter of November 27 advances further arguments as to ,

why the Kudzu Alliance should be permitted to intervene.

f Therefore the Board regards this communication as an '

amendment to your earlier petition. It has not been  ;

served upon the parties but is being s.erved with this  !

letter. The Board will not rule upon the intervention l petition until the parties have had an opportunity to +

respond to your letter of November 27 However, I must caution you that it will be very difficult for the Kudzu i Alliance to demonstrate that it can catch up with this  !

proceeding at this very late stage. You may wish to con-  !

sider discussing with the NRC Staff a forni of limited appearance where you could make your concerns known to i the NRC.  ;
