Dear Sir:

Carolina Power & Light Company (CP&L), a respondent in the above referenced matter, has decided not to request a hearing on the complaint leading to the U. S.

Department of Labor District Director's October 29,1990, determination in this matter.

Although CP&L disagrees with the Director's findings, in particular with the finding on page two, paragraph two that Mr. Dew was harassed and otherwise discriminated against, CP&L has agreed to abide by the District Director's required remedial action rather than request a hearing. This is demonstrated by the attached copy of a letter from counsel for CP&L and CDI, Mr. W. Robert Cherry, Jr. to counsel for Mr. Dew, Mr. Ralph S.

Pennington.

Should Mr. Dew request a hearing on the District Director's decision, however, CP&L of course retains its rights to contest all aspects of the District Director's fingings and decision in the subsequent proceedings before the U. S. Department of Labor. Please contact me if you have any questions.
