Dear Mr. Denton:

The South Carolina Department of Health and Environmental Control (DHEC) is the State Regulatory Agency responsible for environmental programs in South Carolina. DHEC has been delegated all available water pollution control programs by the U.S. Environmental Protection Agency, including the National Pollutant Discharge Elimination System (NPDES). DHEC is, therefore, responsible for issuing NPDES Permits to all dischargers in the State, including steam electric facilities, such as the South Carolina Electric & Gas Company's Virgil Summer Nuclear Power Station.

NPDES Permits are, by Federal statute, valid for a term of no more than five years. The original NPDES Permit for the Summer facility was effective on 21 July 1976 and expired on 21 July 1981. Normally, the permit would have been reissued prior to its expiration; however, due to some complicated EPA regulations which would lead to unnecessary adversarial conditions, DHEC opted to let the permit expire. South Carolina has an Administrative Procedures Act which administratively extends permits of this nature indefinitely until DHEC takes an action on the reissuance application. The permit is, therefore, currently in effect and enforceable. With the pending application for permit reissuance and the administrative extension of the initial permit, the SCE&G Summer facility is in compliance with the NPDES Program requirements.
