REQUEST FOR WITHHOLDING 0F PROPRIETARY INFORMATION During a meeting held on September 29, 1993, Duke Power Company (DPC) and Babcock and Wilcox (B&W) Nuclear Technologies (BWNT) provided to the NRC a proprietary and non-proprietary version of a handout entitled " Duke Power Company Meeting with the NRC Staff to Discuss McGuire Unit 1 S/G A Tube 39-72 Leak." You requested that the proprietary version be withheld from public disclosure in accordance with the Commission's regulations regarding the handling of proprietary information. Since the material you provided was for the general information of the staff and is not intended to be used as a bases for any official action by the NRC, we will review the portions of this material marked as proprietary. On October 1, 1993, you submitted an application and affidavit supporting your claim that the information marked i

" proprietary" was proprietary and should be withheld from public disclosure pursuant to 10 CFR 2.790.

The information reveals data or material concerning BWNT research or development plans or programs of present or potential competitive advantage to BWNT.

statements, have determined that the submitted information sought to be withheld contains trade secrets or proprietary commercial information.

Therefore, the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of

the Atomic Energy Act of 1954, as amended.

Withholding from public disclosure shall not affect the right if any, of persons properly and directly concerned to inspect the documents.

If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available I

for public inspection, you should promptly notify the NRC.
