INTRODUCTION This (ninth) joint progress report responds to the Licensing Board's request in its May 7, 1992, Memorandum and Order (Memorializing Prehearing Conference), ASLBP No. 91-641-02-ML, that "the parties should provide the Board with a [ bimonthly]

joint progress report on their activities for meeting the prehearing schedule."

This report has been reviewed, and found acceptable, by NRC Staff Conasel, Citizens Against Nuclear Trash (Intervenor), and Louisiana Energy Services, L.P.

(Applicant).

LICENSE APPLICATION STATUS The following information submittals and issues related to completion of the NRC staff's Safety Evaluation Report (SER) have occurred recently or remain outstanding.

to the Draft Environmental Impact Statement (DEIS) remains outstanding, and the DEIS is at the printers.

Publication and distribution is anticipated shortly.

The NRC staff has scheduled a meeting with Applicant on November 15, 1993, to clarify technical issues concerning f

the UF Product Sampling Autoclave tilting device.

This is the only remaining outstanding issue with the potential to impact the SER schedule.

The NRC staff met with Applicant on November 2, 1993, to i

discuss Applicant's October 14, 1993, revision to the Proposed License-Conditions.

The NRC staff provided 1

comments to Applicant in a letter dated November 10, 1993.

On November 12, 1993, Applicant submitted revisions to the l

License Application (LA) in response to an NRC staff letter dated November 10, 1993.

The NRC staff also requested revisions to the Safety Analysis Report (SAR) and Proposed

License Conditions.

These will be submitted by Applicant on i

December 3, 1993.

On October 14, 1993, in two separate responses to NRC staff i

comments, Applicant submitted revised sections of the:

f Proposed License Conditions, SAR, and the Criticality Safety Engineering Report, and the Physical Security Plan.

On October 12, 1993, Applicant submitted revised sections of the SAR, Environmental Report, and LA to the NRC staff.

These revisions responded to NRC staff letters to Applicant dated August 17, 1993, and September 1, 15, and 27, 1993, and reflected information submitted to the NRC staff by l

Applicant in letters dated September 21, 24, and 30, 1993.

On October 7, 1993, Applicant submitted revised sections of the Fundamental Nuclear Material Control (FNMC) Plan to the NRC staff in response to a staff letter dated May 7, 1993.

III.

STAFF DOCUMENTS AND HEARING SCHEDULE The NRC Staff's projected publication dates for the SER and DEIS remain unchanged from those reported in the July 15, 1993, Joint Progress Report:

January 28, 1994, and havember 30, 1993, l

respectively.

The DEIS has been completed and is with the printer.

The publication date of the Final EIS, which will l

follow the DEIS publication date by nine months, remains August 30, 1994, but could change depending on the DEIS comments received.

The projected publication date of the SER could be impacted by resolution of technical matters associated with the sampling autoclave tilting device.

These matters will be discussed at the November 15 meeting between Applicant and the NRC staff.

Based on these projected dates and the Board's schedule from i

the May 7, 1992, Memorandum and Order, the following schedule remains unchanged:

Discovery on technical issues will end March 25, 1994 (8 weeks following issuance of SER);

Prefi'ci testimony on technical issues is due May 20, 1994 (8 weeks following end of discovery),

f The hearing on technical issues will start June 10, 1994 (3 weeks following filing of prefiled testimony);

l Discovery on environmental issues will end October 25, 1994 (8 weeks following issuance of FEIS);

Prefiled testimony on environmental issues is due December 6, 1994 (6 weeks following end of discovery),

DISCOVERY

i Discovery activity involves Intervenor's responses to Applicant's Interrogatories served on Intervenor August 11, 1992, and remains unchanged from the July 15, 1993, Joint Progress Report.

Intervenor served the parties with answers to a number of Applicant's Interrogatories on March 19, 1993.

Answers to the remaining Interrogatories are due to be filed sixty days prior to I

the close of discovery.

CONTENTIONS f

The status of Intervenor's Contentions has not changed since i

the January 15, 1993, Progress Report and is omitted from this report.

Changes, if any, will be reported as they occur.
