on behalf of the National Whistleblower Center and Charles A. Webb and by Ron i Shackelford on behalf of the Coastal Alliance for a Safe Environment, the NRC t

was asked to suspend the operations of the Brunswick Steam Electric Plant (BSEP), Units 1 and 2, pending criminal investigation. As part of the Petition to suspend the operation of BSEP the Petition requests that (1) the NRC staff enter into a confidentiality agreement with the National ,

Whistleblower Center to facilitate the release of additional information; (2) the NRC immediately require the licensee to state whether it has, in fact,  ;

known about cracks in the reactor shroud since 1984, and (3) the NRC's Office of Investigations determine whether Carolina Power & Light Company (the licensee) has engaged in criminal wrongdoing commencing in 1984 when the licensee initially failed to report the existence of cracks in the reactor shroud to the NRC.

As the basis for their Petition, the Petitioners state in the Petition that: the licensee falsely asserted to the NRC and to the public that cracks in the reactor shroud were recently discovered, but, in fact, the licensee discovered the cracks nine years earlier and the licensee's management instructed the engineers who detected the cracks to prepare paperwork that _j 9311100004 931115 PDR ADOCK 05000324 I lg C PDR 1700h NRC F!LE CINIR elfPY i i

I would ensure that no report would be made to the NRC; and this unwillingness l to report significant safety problems to the NRC demonstrates that the licensee does not have the character or integrity to operate a nuclear facility; and that the licensee is willing to take unreasonable risks with the public health and safety.

The Petition has been referred to the Director of Nuclear Reactor l Regulation pursuant to 10 CFR 2.206. As provided by 10 CFR 2.206, appropriate action will be taken regarding the specific issues raised by the Petition in a reasonable time. By letters dated 11/15/93 the Director denied the Petitioners' request to suspend the operations of Units 1 and 2 pending criminal investigation. The Petitioners' request to immediately require the licensee to state whether it knew of cracks in the reactor shroud of Unit 1 in 1984 is under review for any action the NRC may deem appropriate.

A copy of the Petition is available for inspection at the Commission's Public Document Room at 2120 L Street, N.W., Washington, DC 20555.
