50.55a(g)(5)(iii), from the requirements of the 1986 Edition of the ASME l Boiler and Pressure Vessel Code,Section XI, Article IWF-5000, related to l inservice inspection of safety-related snubbers during the second ten-year interval. The Unit 1 Technical Specifications (TS) consists of three sampling plans for snubber functional tests, one of which is identical to that required by Section XI. Section 4.7.8 of the TS requires that snubbers be tested using one of three sampling plans. The granting of the relief request would allow ,

Duke Power Company the flexibility in selecting a sampling plan that may l differ from that required by the ASME Code Section XI. l The NRC staff has reviewed your request and conclude that compliance with the ASME Code Section XI requirements would result in unnecessary redundancy to the assurance provided by compliance to the plant TS, and is therefore, impractical. Therefore, pursuant to 10 CFR 50.55a(g)(6)(i), your request for relief is granted. Our evaluation is enclosed. )
