By your affidavit dated April 19, 1990, transmitted in an April 25, 1990 letter from G. A. Hunger, Jr.,' of.the Philadelphia Electric Company-to the NRC. you submitted " Safety Evaluation of the Reuse of Channels for a Second Bundle Lifetime'in Peach Pottom 2, Cycle 8" and requested that the submitted information be withheld from public disclosure pursuant to 10 CFR 2.790.

In addition, by your affidavit dated July 31, 1990, transmitted in an August 3, 1990 letter from G. A. Hunger, Jr...of the Philadelphia Electric Company to a

the NRC, you submitted " Response to NRC Question on PECO Reuse Channel Bow l

Evaluation" and requested that the submitted information be withheld from

public disclosure pursuant to 10 CFR 2.790.

You stated that the submitted information should be considered exempt from I

mandatory public disclosure based on the determination that the submitted documentation has been found to contain information which is proprietary and which is customarily held in confidence by General Electric. The information was stated to have been consistently held in confidence by the General Electric Company; nopublic{selosureshavebeenmade; and the information is not available in public sources.

In addition, all disclosures to third parties were stated to have been made pursuant to regulatory provisions or proprietary agreements which provide for maintenance of the information in 1

confidenc5. You further stated that public disclosure of the inf a tion is likely t, cause substantial harm to the competitive position-of the General i

Electric Company and deprive or reduce the availability of profit making i

opportunities because it would provide other parties, including competitors, j

We have reviewed your application and the material in accordance with the.

requirements of-10 CFR 2.790 and, on the basis of General. Electric's statements, have determined that the submitted information sought to be withheld contains trade secrets or proprietary commercial information.
