CONFIRMATION OF AS EXPEDITIOUSLY AS PRACTICABLE DATES FOR FINAL COVER AT THE 13 SUBPART T MILLS The Nuclear Regulatory Commission (NRC) and the Environmental Protection Agency (EPA) are in consultation on rescinding Subparts T and W of 40 CFR 61.

As part of these discussions, EPA requested verification that the NRC determined that each mill used appropriate milestone dates that are expeditious as practicable.

In other words, were the milestone dates submitted by each licensee as conservative as possible, and were these dates reviewed by the staff to determine the earliest practicable date? The answer to these questions is yes.

By letter dated October 22, 1991, each licensee was requested to submit a license amendment request containing a firm schedule for the final earthen cover at their facility.

It was stated in that letter that the dates submitted must be " expeditious as practicable, considering technological feasibility."

The licensees submitted amendment requests as directed by the October 22 letter over the next several weeks. Each submittal was reviewed by the appropriate project manager, the reclamation review team, and the Deputy Director for the earliest practicable date of compliance. Whenever a milestone date was determined not to be conservative, additional consultation was conducted with the licensee.

The following list of licensees submitted milestone dates that the staff felt were sufficiently conservative to meet the intent of the MOV with EPA:
