i On August 14, IN O, AE00 met with represtntatives from NUMARC and the BWROG, at NRC headquarters in Bethesda, MD, to discuss the licensee event reporting (LER) requirements pursuant to Title 10 Code of Federal Regulation Part 50.73.

The purpose of the meeting was to exchange information on the NRC's intent and the industry's implementation of the event reporting requirements, as required under the existing rule. A copy of the agenda is attached, t

In his opening remarks, Mr. T. Novak, Director, Division of Safety Programs, AE0D, welcomed the attendees and expressed appreciation for their activities to promote a better understanding of event reporting requirements for BWRs.

The industry representation was by Nuclear Management and Resources Council e

(NUMARC) and the Boiling Water Reactor Owners Group (BWROG),

However, as stressed later, the reporting requirements discussed throughout the course of the meeting were generic and applicable to PWRs.

  • 1mation of the BWROG LER/JC0 Committee, its objectives, and their ac'ivities to develop guidelines for more consistent event reporting given the versity and disparity in reporting between various utilities and between various plant sites owned and operated by the same utility.

An ad hoc committee was formed by BWR utilities in November 1989 and was formally established as BWROG LER/JC0 Comittee in January 1990.

The focus of the WROG LER/JC0 Comittee (hereafter referred to as "the Committee") regardiag LERs has been to develop guidelines for event reporting for use of the member BWR utilities to ensure uniformity and consistency.

Draft guidelines were developed in April 1990. Their efforts are expected to continue through the end of the year.

PWR utility involvement has been I

encouraged. While at present, there is no formal involvement of the other three NSSS Owners Groups, about 16 PWR utilities have been participating in the Committee activities.

The Committee's draft guidelines specifically focus on events involving ESF l

actuations, technical specification variance, loss of safety system function, and thosc events rendering the plant outside its design basis or in an L

unanalyzed condition. The Committee's focus is narrow and their continuing efforts are directed at providing event reporting guidance within the existing LER rule to set the threshold such that individually safety significant events are consistently reported.

The NRC staff briefly addressed NRC's reactor operational experience rcview programs, and AE00 aroducts such as Case Studies and Trends and Patterns analyses which are sased on LER information. The staff also emphasized the intent of the existing LER rule and the need to continue to receive LERs on events some of which may not be individually safety significant but they do contribute to the staff's assessment of generic implications and for trends and patterns analyses.

The Committee expressed the need to know the

" threshold" for event reporting. The staff acknowledged the diversity of opinions on event reporting (and varied focus on the types of events) within NRC program offices and the Regions. The staff re-iterated that as currently prescribed in 10 CFR 50.73, operating experience has shown that the threshold results in some events being reported with little, if any, safety significance.

The staff noted that until the event reporting requirements are modified, compliance with 50.73 is required, in response to the Committee's concern that the number of LERs is being perceived by others (public, media, Public Utility Service Commissions) as being related to less-than adequate plant performance, Mr. Novak indicated that ths NRr staff is assessing the experience with the LER rule over the past 6 years.

'he staff is also evaluating the current reporting requirements for the need to reduce reporting of events that, based on staff reviews, are no longer needed for safety evaluations.

Staff is also considaring clarifications to capture events that were intended to be reported but are not being reported.

Staff indicated that it has under consideration minor rulechange activities which may reduce the NRC and the industry burden by dele';ing requirements for reportirg events which pose no safety concerns, and by providing better guidance for more consistent repc-ting of potentially safety signiftcant events.

The pcssibility of a second information exchange meeting to be held prior to the planned NRC workshops on event reporting was discussed.
