SUBJECT: NOTICE OF VIOLATION

(NRC INSPECTION REPORT NOS. 50-348/93-26 AND 50-364/93-26)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

M. Morgan on September 23 - October 25, 1993, at the Farley Nuclear Plant.

The inspection included a review of the facts and circumstances related to

several examples of personnel error that resulted in the loss of configuration

control during maintenance and testing activities. As a result, a. violation

of NRC requirements was identified. An enforcement conference was conducted

in the NRC Region II office on November 17, 1993, to discuss the violation,

its cause, and your corrective actions to preclude recurrence. This

enforcement conference was open for public observation in acccrdance with the

Commission's trial program for conducting open enforcement conferences as

discussed in the Federal Reaister, 57 FR 30762, July 10,1992.

The violation in the enclosed Notice of Violation (Notice) involves three

examples of the failure to maintain configuration control which were self-

disclosing or identified by your staff. Although the three specific events ,

were unrelated, they were similar in that personnel error was involved that

resulted from a lack of attention to procedural requirements and inadequate

planning prior to initiation of maintenance activities.

Because of the low safety significance associated with these events, the

thorough root causs analyses, and the extensive corrective actions you

identified during the enforcement conference, the violation has been-

categorized at Severity Level IV. We understand that the cause of these

events (primarily improper planning) was different from recent similar

problems of improper implementation. We also understand that the misoperation

of valve No. 3130A affected an out-of-service versus on-line heat exchanger as

stated in our inspection report.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. In your ,

response, you should document the specific actions taken and any additional

actions you plan to prevent recurrence. After reviewing your response to this

Notice, including your proposed corrective actions and the results of future

inspections, the NRC will determine whether further NRC enforcement action is-

necessary to ensure compliance with NRC regulatory requirements.

In accordance with Section 2.790 of the NRC's " Rules of Practice," a copy of:

this letter and its enclosures will be placed. in the NRC Public Document Room.

The response directed by this letter and the enclosed Notice is not subject to

the clearance procedures of the Office of Management and Budget as required by

the Paper Work Reduction Act of 1980, Pub. L. No.96-511.
