Dear Mr. Kohn:

This letter is in. response to the petition you filed on April 28, 1993, on behalf of the National Whistleblower Center.

Your petition was considered pursuant to Title 10 of the Code of Federal Reaulations, Section 2.206 (10 CFR 2.206).

You assert that you received allegations from a Brunswick-Steam Electric Plant, Units I and 2, (BSEP or Brunswick) employee on which you based your petition asking the United States' Nuclear Regulatory Comission

-(NRC or the Comission) to'immediately shut down Brunswick until such time as the problems have been fully resolved. These' allegations stated that (1) there has been a complete breakdown in the quality assurance.(QA) program that' oversees the integrity of the plant's vendor manuals; (2) there has been a breakdown in the plant's security system, which may leave the facility open to terrorist attack; (3) there has been harassment and intimidation _of employees who raise safety-related concerns to their management; (4) there has been a failure of Carolina Power & Light Company to train the contractors it has employed in the proper QA procedures and a failure to implement a QA program in the work assignments of the contractors; and (5) there has been a breakdown

On June 7, 1993, I informed you that your request was being treated under

10 CFR 2.206 of the Comission's regulations and that a formal decision would be issued within a reasonable time.

your petition has been denied. A copy _of the decision will be filed with the Secretary of the Comission for the Comission's. review in accordance 'with 10 CFR 2.206(c). As provided by this regulation,- the decision will constitute the final action of the Comission 25 days after the date of issuance of the decision unless the Comission, on its own motion, institutes a review of the decision within'that time.
