Nuclear Regulatory Commission's (NRC) request for comments on the proposed rule " Notifications of Incidents" affecting 10CFR Parts 20, 30, 40 and 70 (55FR19890, May 14, 1990).

Although the proposed rule clearly states that it does not apply to activities reportable under 10CFR^Part 50, many commercial nuclear power plants also hold licenses-issued.

'under.10CFR^ Parts 20, 30, 40 and 70, or these parts are incorporated into.their Part 50 license.

We believe it is the intent.of.the Staff that the proposed reporting requirements not~ apply =to. power reactors.

This should be clarified in the' language'of tha rule by referring to the-applicable reporting requirements.of Part 50 (i.e.,

10CFR50.72 and'50.73) for commercial nuclear power reactors.

This comment applies to each part of Title 10 that would be affected by the proposed.ghange.
