j I am responding to the letter that you and Senator Dodd unt to Mr. Dennis K. Rathbun, Director of the Office of Congressional Affairs, on 4

i November 23, 1993, in which you requested a written status report on the issues raised by Ms. Mary Ellen Marucci (as described in your September 17, I

1993, letter to Chairwan Selin).

In your letter of September 17, 1993, you noted two major points that i

Ms. Marucci has raised with your staff. First she is concerned that there i

will not be adequate monitoring of the spent fuel pool at Millstone 2 nuclear power plant to provide continuous information concereirs the potential for i

supercriticality. Second, Ms. Marucci is concerned that all of the scientific and technical information she submitted may not have been seen or fully considered.

As discussed with your staff during our briefing on October 19, 1993, the NRC staff evaluated all of the issues raised by Ms. Marucci, and the Atomic Safety j

Licensing Board (ASLB) reviewed issues during its consideration of a request 3

i for a hearing by the Cooperative Citizens' Monitoring Network (CCMN) regarding the modification of the Millstone 2 spent fuel pool. Ms. Marucci is the coordinator for CCMN.

I CCMN's contention regarding criticality concerns was the only contention admitted by the ASLB to the proceeding. NRC evaluation of the contentions was documented in "NRC Staff Response to Supplemental Petitions and CCHN Contentions," dated September 14, 1992. Northeast Nuclear Energy Company i

(NNECO) also addressed the contentions in its response of September 8, 1992.

Ms. Marucci has copies of all of the documentation cited. We have also previously responded to Ms. Marucci's concerns by letter to you dated i

September 29, 1992, which enclosed a copy of the staff's responses dated September 14, 1992. We are enclosing a copy of the September 29, 1992, letter together with the NNEC0 letter of September 8,1992, for your convenience.

Contention 1 on grounds that the contention has not raised a genuine issue of material fact. On May 28, 1993, the NRC staff filed its response in support 4
