PROPOSED IMPOSITION OF CIVIL PENALTY - $237,500 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $237,500 i

will be issued on or about December 3, 1993 to Northeast Nuclear Energy Company (Millstone Unit 2).

This action is based on the l

violations associated with the licensee's repeated attempts to repair a body-to-bonnet leak on a letdown valve that was unisolable from the reactor coolant system.

Ultimately the repeated repair attempts resulted in the failure of one of the valve's four bonnet studs which led to a reactor shutdown when I

the technical specification limit for reactor coolant system leakage was exceeded.

The three violations being cited have been combined into a single Severity Level III problem.

The base civil penalty of $50,000 has been escalated 275 percent by I

applying the Enforcement Policy factors for NRC identification of the violations, insufficient long term corrective actions, poor past performance, and the duration of the violations.

In l

addition, given the egregious nature of the licensee management's failure to properly oversee this activity the staff has decided to exercise discretion in accordance with Section VII.A.(1) of l

the Enforcement Policy and increase the proposed civil penalty an l

additional 100 percent.

Therefore, on balance the base civil l

penalty has been escalated by 375 percent.

It should be noted that the licensee has not been specifically informed of the enforcement action.

The schedule of issuance and notification is:

Mailing of Notice December 3, 1993 Telephone Notification of Licensee December 3, 1993 The State of Connecticut will be notified.

The licensee has thirty days from the date of the Notice in which l

to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
