SUBJECT: NOTICE OF VIOLATION
(NRC INSPECTION REPORT NOS. 50-325/90-43AND50-324/90-43)
This refers to' the inspection conducted by F. N. Wright of this office on
October 15-19, 1990. The inspection included a review of activities authorized
for your Brunswick facility.
At the conclusion of the inspection, the findings
were discussed with those members of your staff identified in the enclosed
report.
During a telephone conversation on November 2, 1990, between
G. Cheatham of your staff and F. Wright of the Nuclear Regulatory Connission
(NRC) your staff was notified that failure to take adequate and timely
corrective actions to preclude continuing violations of Technical Specification
requirements-for controlling access to high radiation areas, appeared to be a
violation of 10 CFR 50 Appendix B, Criterion XVI
Corrective Action.

Areas examined during the inspection are identified in the report.
Within
these areas. .the inspection consisted of selective examination of procedures
and representative records, interviews with personnel, and observation of -
activities in progress.

Based on the results of this inspection, certain of your activities appeared to
be in violation NRC requirements, as specified in the enclosed Notice of
Violation.
The violation described in the enclosed Notice is similar to a
violation contained in the Notice sent to you by our letter dated March 8,
1990,
including Inspection Report No. 90-06, dated March 8, .1990, we have
]
documented seven similar instances of inadequate high radiation area access
?
controls.- Recurring violations are of particular concern because the NRC
expects licensees to' learn from their past failures and to take effective
corrective actions. Although the NRC does not normally consider monetary civil
penalties for Severity Level IV violations, the Enforcement Policy states that
'
such penalties may be imposed for Severity Level IV violations that are similar
to previous violations for which the licensee did not take effective corrective
action.
In-this case, we'have' decided not to hold an enforcement conference
nor to propose a civil-penalty. With.one exception, all of the violations were
identified and documented by your staff monitoring compliance with Technical-
.
Specifications requirements and there was no evidence.that unplanned personnel

radiation exposures occurred.
Following the September 20, 1990 ever.t. the
staff took additional corrective actions to ensure that doors to high radiation -
,
areas were properly accessed and controlled by requiring Health Physics staff
,
to monitor each high radiation area entry and exit.
You are recuired to respond to this letter and should follow the instructions
specified 'n the enclosed Notice when preparing your response.
In your
response, you should document the specific actions' taken and any additional
+
actions you plan to-prevent recurrence. After reviewing your response to this
Notice, including your proposed corrective actions and the results of future
inspections, the NRC will determine whether further NRC enforcement action is
necessary to ensure compliance with NRC regulatory requirements.
In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of'

this letter and its_ enclosures will be placed in the NRC Public Document Room.
The responses directed by this letter and thL enclosed Notice are not subject
to the clearance procedures of the Office of Management and Budget as required
