Gulf States Utilities Docket: 50-458 River Bend Station License: NPF-47 '

St. Francisville, Louisiana During an NRC inspection conducted on August 22 through September 25, 1993, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2,  !

Appendix C, the violation is listed below:  ;

A. Failure to Establish Procedures i Technical Specification 6.8.1 requires, in part, that written procedures l shall be established, implemented, and maintained, covering the  :

applicable procedures recommended in Appendix A of Regulatory  !

Guide I.33, Revision 2, February 1978.

i Regulatory Guide 1.33, Appendix A, recommends, in part, procedures for combating abnormal releases of radioactivity and for limiting materials ,

released to the environment. 1 Contrary to the above, the Main Control Room Radiation Monitoring i Panel RM-ll annunciator did not have an alarm response procedure for  ;

liquid radiation Monitor RMS-RE108. Consequently, immediate and long-range operator actions were not established for liquid radiation Monitor RMS-RE108 when it alarmed on September.7, 1993, indicating that  ;

an unexpected radioactive liquid discharge from the main cooling tower was occurring.

This is a Severity Level IV violation. (458/93026-1) (Supplement I) ,

i B. Failure to Initiate Prompt Corrective Actions ,

Criterion XVI, to 10 CFR 50, Appendix B, requires that measures shall be i established to assure that conditions adverse to quality, such as -l f ailure malfunctions, deficiencies, deviations, defective material, and  :

equipment and nonconformances are promptly identified and corrected.

Contrary to the above, on September 7,1993, the main control room

, operators failed to promptly initiate measures to terminate or adequately verify the validity of main cooling tower Radiation ,

Monitor RMS-RE108 when it alarmed during a liquid radioactive  !

, waste (LRW) discharge. This condition had existed from approximately 4:08 p.m. (CDT) until 6:42 p.m., when the discharge was terminated.

Consequently, over 500,000 gallons of water, with potentially greater  !

than expected radioactivity, was discharged to the Mississippi River.

Pursuant to the provisions of 10 CFR 2.201, Gulf itates Utilities is hereby required to submit a written statement or explanation to the U. S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV, and a copy to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should clearly be marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results aghieved, (3) the corrective steps that vill be taken to avoid further v!olations, and (4) the date when full campliance will be achieved. If an aJequate reply is not received within d.e time specified in this Notice, an crder or demand for information may be issued as to why the license should not te modified, suspended, or revoka d, or why such action as may be proper should r,ot be taken. Where good cause s shown, consideration will be given to rxtending the response time.
