Dear Mr. Milton:

This letter refers'to the inspection conducted by Mr. Steven M. Matthews and Ms.' Ann M. Fitzgerald of this office on July 16-18, 1990, at your facility in Chicago, Illinois and the discussion of the findings with Mr. Shn Laskowski,

Manager, Quality Assurance of your staff at the conclusion of the irpection.

The inspection was conducted to assess the manufacturing process of safety-related structural steel welded tube sections; the analysis, corrective action, and resolution of'a 10 CFR Part 21 report of cracked and incomplete butt welds; and the' implementation of your quality progra:a in selected areas. Areas examined during the inspection and our findings are discussed in the enclosed report.. This inspection consisted of an examination of procedures and a

representative records, interviews with personnel, and o)servations by the

.l inspectors. The assessment was determined through performance-based reviews _of.

-these' areas.

.The most significant of the inspection findings was the failure of Welded Tube CompanyofAmerica(WTC)toperformtherequiredevaluations.ofpotentially reportable _ deviations or to inform purchasers so they could cause an evaluation to be performed pursuant to the provisions of 10 CFR Part 21. The Nuclear Regulatory Consnission (NRC) inspectors reviewed two deviations regarding cracked 4

or incomplete welding of safety-related structural steel tubing sections which were not evaluated in accordance with 10 CFR Part 21.

In accordance 'with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1990), the violation described in'the enclosed Notice of Violation has been classified as a Severity Level III violation because WTC did not evaluate the deviation or

notify licensees or purchasers of the deviation.

You are required to respond to this letter and should follow the instructions I

specified in the enclosed Notice of Violation when preparing your response.

In your response you should document the specific actions taken and any additional actions you plan to prevent recurrence. After reviewing your response to.this s

Notice of Violation,-including your proposed corrective actions and the results of future inspections, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.

During this inspection it was also found that the implementation of your quality program failed to meet certain NRC requiresients and resulted in the identification of-several nonconformances. The inspection identified that, contrary to the requirements of 10 CFR Part 50, Appendix B WTC failed to adequately implement a program to provide for indoctrination and training of 4

personnel, to provide documented procedures, and to control the inspection and E

process monitoring of activities affecting the quality of safety-related structural steel tubing sections. The specific findings and references to the pertinent requirements are identified in the enclused Notice of Nonconformance.

Please provide us within 30 days from the date of this letter a written statement with respect to this Notice of Nonconformance containing: (1)a i

description of steps that have been or will be taken to correct these items; (2)~ a description of steps that have been or will be taken to prevent-recurrence; and (3) the dates your corrective actions and preventhe measures were or will be completed. We will consider extending the response time if i

you can show good cause for us to do so.

The responses requested by this letter are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork

Reduction Act of 1960 PL 95 511.

In accordance with 10 CFR Part 2.790 of the Consnission's' regulations, a copy of this letter and its enclosures will be placed in the NRC's.Public Document Room.
