SUBJECT: NOTICE OF VIOLATION AND NRC INSPECTION REPORT N0. 50-461/93019(DRP)
Dear Mr. Perry:
This refers to the inspection conducted by Messrs. P. G. Brochman,
F. L. Brush, and A. M. Stone of this office on September 14 through
October 25, 1993. The inspection included a review of authorized activities
for your Clinton Power Station facility.
At the conclusion of the inspection,

the findings were discussed with those members of your staff identified in the
!
enclosed report.

Treas examined during the inspection are identified in the report. Within
these areas, the inspection consisted of a selective examination of procedures
and representative records, observations of activities in progress, and
interviews with personnel.
,
Based on the results of this inspection, certain of your activities. appeared
to be in violation of NRC requirements, as specified in the enclosed Notice of
Violation (Notice). The violation is of concern because your engineering
staff's failure to understand the clear design requirement for the diesel fire
pump to be capable of being controlled from either battery was compounded by a
non-challenging design review and insufficient post-modification testing.

Although 10 CFR 2.201 requires you to submit to this office, within 20 days of
your receipt of this Notice, a written statement of explanation, we note that
this violation had been corrected and those actions were reviewed during this
inspection. Therefore, no response with respect to this matter is required.
Additionally, certain other of your activities also appeared to be in
violation of NRC requirements. However, as described in the enclosed
inspection report, you identified these violations. Therefore, the violations
will not be subject to enforcement action because your efforts in identifying
and correcting the violations meet the criteria specified in Section VII.B of

the " General Statement of Policy and Procedure for NkC Enforcement Actions,"
(Enforcement Policy,10 CFR Part 2, Appendix C).

The declining trends in following the safety tagging procedure and control of
foreign material over the open reactor vessel are of concern to the NRC.
You
should aggressively continue the corrective actions you have implemented on
these two problems and identify strategies to prevent their recurrence in your
next refueling (RF-5).
In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of
this letter and the enclosures will be placed in the NRC Public Document Room.
We will gladly discuss any questions you have concerning this inspection.
