Pursuant to 10CFR50.90, GPU Nuclear Corporation, operator of the 3

Oyster Creek Nuclear Generating Station (OCNGS),. Provisional Operating License No. DPR-16, requests a change to Appendix A of that license.

The attached Technical. Specification Change Request proposes to eliminate'seven'(7) maintsteam safety valves with the two highest set

' points.:.This request replaces the-original license amendment request dated December 18, 1989'in its entirety. The original design for

' Oyster Creek: Reactor Vessel was ASME Section I'1962 edition which was interpreted'to require that,the safety valve capacity be such that l

all potentially generated steam by the boiler (reactor vessel) be t

discharged without credit for fuel stoppage. The ASME Section I deals specifically with power boilers and not. nuclear reactors.

Recent. codes and standards (ASHE Section I and III). recognize operating controls or safety controls for the protected system _upon-4"o which the: required' relief capacity is predicted.

In addition, NUREG

Based'on the above,.GPUN proposes'that the high flux scram be used'

\\$O for, determining the safety valve capacity, with-the result being a

significantly, reduce radiation' exposure, probability of failures,

i We' request'the NRC staff to place an appropriate priority for a timely review of these proposed Technical Specification changes, such that the modification can be scheduled and completed during the 13R outage.

i This change request has been reviewed in accordance with Section 6.5

'of the OCNGS Technical Specifications, and using the standards in 10 CFR 50.92 we have concluded that these proposed changes do not constitute a significant hazards consideration.

Pursuant to 10CFR50.91(b)(1), a copy of this change request has been 1

sent to the State of New Jersey Department of Environmental Protection.
