SUBJECT: NOTICE OF VIOLATION

NRC INSPECTION REPORT NOS. 50-528/529/530/93-35

This refers to the inspection conducted by J. Sloan, H. Freeman,

A. MacDougall, B. 01 son, and F. Ringwald of this office, and T. Alley, of the

Department of Energy, on July 13 through August 16, 1993. . The inspection

included a review of activities' authorized for your Palo _ Verde facility. At

the conclusion of the inspection, the findings were discussed with those

members of your staff identified in the enclosed report.

Areas examined during the inspection 'are identified in the report. . ithin

these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with personnel, and observation of

activities in progress.

Based on the results of this inspection, certain of your activities appeared

to be in violation of NRC requirements, as specified in the enclosed Notice of

Violation (Notice). These violations involved: (1) the failure of the Offsite

'

Safety Review Committee to review significant operational abnormalities

identified in 1991 in Steam Generator 22 involving abnormal crack rowth rates

,

'

in certain steam generator tubes and of a midspan tube crack, and 2) several

inadequacies in the Emergency Operating Procedures (EOP) identifie during the

i

steam generator tube rupture in Unit 2 in March 1993. We noted that the

second violation regarding E0P deficiencies had been corrected and those

actions were reviewed during this inspection. Therefore, no response with

respect to this matter is required.

We also identified two instances of a failure to pro)erly document

'

surveillance test deficiencies. This is of concern 3ecause similar examples

were previously identified in the Notice of Violation issued with NRC

Inspection Report 50-528/93-26.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response to the first

violation.

In your response to Violation A, you should document the specific

actions taken and any additional actions you plan to prevent recurrence.

After reviewing your res)onse to this Notice, including your proposed

corrective actions and tie results of future inspections, the NRC will

determine whether further NRC enforcement action is necessary to ensure

compliance with NRC regulatory requirements.

In accordance with 10 CFR Part 2.790 of the NRC's " Rules of Practice," a copy

of this letter and the enclosures will be placed in the NRC Public Document

Room.

The responses directed by this letter and the enclosed Notice are not subject

to the clearance procedures of the Office of Management and Budget as required

by the Paperwork Reduction Act of 1980, Pub. L. No.96-511.

Should you have any questions concerning this inspection, we will be glad to

discuss them with you.
