EXEMPTION FROM PORTIONS.0F 10 CFR 50.54(q) AND CERTAIN SECTIONS OF 10 CFR 50.47, " EMERGENCY PLANS," AND 10 CFR 50, APPENDIX E, " CONTENT OF EMERGENCY PLANS" FOR THE TROJAN NUCLEAR PLANT (TAC NO. M85980)

By letter dated March 9,1993 Portland General Electric (PGE) requested exemption to certain sections of 10 CFR 50.47, " Emergency Plans", and 10 CFR Part 50, Appendix E, Paragraph IV, " Content of Emergency Plans." Due.to the non-operating defueled condition of the Trojan Nuclear Plant, you requested that offsite emergency preparedness be eliminated and the Trojan Emergency.

Plan address only onsite activities.

Based on the considerations' discussed in the exemption, we have concluded that the information provided, and the actions described in the application, form -

an acceptable basis for granting the enclosed exemption. The Commission has determined, pursuant to 10 CFR 50.12, that the exemption is authorized by' law, will not present an undue risk to the public health and' safety, and is consistent with the common defense and security.

A copy of the exemption is being forwarded to the Office of the. Federal Register for publication. Also enclosed are copies of the staff. Safety

- Evaluation in support of the Exemption, and the Environmental Assessment and' Finding of No Significant' Impact.

Cross September 30, 1993 The staff has also completed the review of the proposed Permanently Defueled Emergency Plan (PDEP) for the Trojan Nuclear Plant submitted by letter dated March 9, 1993 and revised on September 23, 1993. The staff has concluded that implementation of the Trojan PDEP will maintain an acceptable level of emergency preparedness for the plant in its shutdown and defueled condition.

Therefore, the staff approves the Trojan PDEP.
