q APPENDIX A NOTICE OF VIOLATION Entergy Operations, Inc.
Docket:
50-382 Waterford Steam Electric Station, Unit 3 License: NPF-38 During an NRC inspection conducted on July 26-30 and August 26, 1993, a violation of HRC requirements was identified.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is listed below:
Criterion V of Appendix B, 10 CFR Part 50, states, in part, that activities affecting quality shall be prescribed by documented procedures and shall be accomplished in accordance with these procedures.
Waterford 3 Procedure UNT-005-002, " Administrative Procedure Condition Reports," Revision 10, states, in Section 4.1.1, that Waterford-3 employees are responsible for "[r]eporting and identifying abnormal conditions upon observation and initiating a condition identification to obtain resolution. Conditions adverse to quality shall also be further identified as a Nonconformance Condition Identification (NCI)."
Contrary to the above, the licensee failed to identify and initiate Nonconformance Condition Identifications for the ASME Section III pressurizer safety valves exceeding the I percent tolerance specified in the Technical Specifications in December 1986, April 1988, January 1991, and June 1992. The licensee also failed to identify and initiate Nonconformance Condition Identifications for the main steam safety valves when their as-found set pressures exceeded the 1 percent tolerance specified in the Technical Specifications in November 1986, April 1988, September 1989, and March 1991.
This is a Severity Level IV violation (Supplement I) (382/9325-01).

Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C.
20555 with a copy to the Regional Administrator, Region IV, 611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation:
(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
