PROCESSING AND REGULATORY ISSUE SUMMARY (RIS) 2016-11,

REQUESTS TO DISPOSE OF VERY LOW-LEVEL RADIOACTIVE WASTE

PURSUANT TO 10 CFR 20.2002

Dear Ms. Dauberger:

I am responding to your February 14, 2020, email, TN [Tennessee] BSFR [Bulk Survey for

Release] Processing (Agencywide Documents Access and Management System [ADAMS]

Accession No. ML20057D249). In your email, you requested that the U.S. Nuclear Regulatory

Commission (NRC) send a letter to UniTech Services Group that is similar to the letter that the

NRC sent to Waste Control Specialists on September 16, 2019, (ADAMS Accession No.

ML19210B090). You stated that [m]any power plants believe that the TN BSFR program is not

approved by the NRC.

The transfer of low-level waste from a power plant to UniTech Services Group is permissible

under 10 CFR 20.2001(a), as long as it meets all applicable requirements of your Tennessee

license. The issue to which your email refers, regarding RIS 2016-11 and EA-18-137, concerns

NRC licensees that propose to dispose of very low-level radioactive waste in an unlicensed

facility in accordance with 10 CFR 20.2002.

Please feel free to share this letter with any of your power plant customers with questions about

the permissible transfer of licensed material to UniTech Services Group for processing and

subsequent disposal. If you have any questions, please contact Stephen Dembek at
