TELEDYNE ENERGY SYSTEMS

REFERENCE:

Teledyne letter dated September 21, 1993, to Mr. Charles E.

MacDonald regarding " Quality Assurance Program Approval No. 0397."

Teledyne Energy Systems requested (please see enclosure) that their Quality Assurance (QA) Program Approval No. 0397 be terminated effective September 21, 1993. Teledyne also requested that the Certificates of Compliance (C0Cs) of certain packaging, for which Teledyne is certificate holder, be transferred to the U.S. Navy and U.S. Air Force.

Please note that for the C0Cs to remain valid, Teledyne's QA Program Approval must remain in effect. Once the C0Cs have been transferred, the QA Program may be terminated. The Cask Certification Section/STSB/IMNS has begun the process of working with the Navy and Air Force to transfer the C0Cs. However, this will take several weeks which will require that Teledyne's QA Program remain in effect into FY 1994.

In our view Teledyne provided timely notification to the U.S. Nuclear Regulatory Commission of their desire to terminate their QA Program Approval.

Therefore, we recommend that you give similar consideration to the issue of FY 1994 fees for Teledyne.
