O McGuire Nuclear Station Reply to a Notice of Violation Violation 369. 370/93-10-02 Technical Specification 6.8.1 states that written procedures shall be established, implemented and maintained.

Implementing procedure RP/O/A/5700/00, Classification of Emergency, section 2.0, immediate Actions, step 2.1 instructs the user to compare actual plant conditions to the Emergency Action Level (s) listed in Enclosure 4.1 then declare the appropriate Emergency Class as indicated.

Contrary to the above, a loss of offsite power event on Unit 1 occurred at 13:55 hours on February 11, 1991, for which the licensee failed to immediately declare a Notification of Unusual Event. Instead, the licensee classified a subsequent event as a Notification of Unusual Event based on valid Safety injection signal, at 14:20 on February 11,1991.

This is a Severity Level IV violation (Supplement Vill).

Reolv to Violation 369. 370/93-10-02 The Basis for Disputina the Violation:

Duke Power Company disputes the violation based on the following:.3 Emergency Declaration Guidelines of RP/O/A/5700/00, Classification of Emergency instructs Operators that if plant conditions require implementation of EP/1 or 2/A/5000/01, Reactor Trip or Safety injection, increased emphasis shall be given to evaluation of plant conditions for determination of EAL(s) when "kickout" of the diagnostic procedure occurs. This is further re-enforced in Operator training to ensure that emphasis is given to evaluation of plant conditions in diagnosing the event prior to considering the EAL(s). The Operators, in dealing with the diagnostic procedure, were challenged by many changing plant parameters, indications of a possible steam leak as evidenced by excessive primary plant cooldown, adverse containment conditions (i.e., temperature and pressure increasing) and ice condenser inlet door j

alarms indicating open.
