NOTICE OF ENFORCEMENT DISCRETION FOR COMMONWEALTH EDISON COMPANY REGARDING THE BRAIDWOOD STATION UNIT 1
Dear Mr. DelGeorge:
i By. letter dated September 17, 1993, you requested the U.S. Nuclear Regulatory l'
Commission (NRC) to exercise its discretion not to enforce compliance with the required actions in Technical Specification (TS) 3.1.2.4.
Your staff-informed the NRC on September 17, 1993, that the Braidwood Station Unit 1, would not be in compliance with TS 3.1.2.4 with regard to having the inoperable charging pump _
" operable" within the specified allowable time. Specifically, your letter stated that. at 5:05 p.m., on September 15, 1993, Braidwood Unit 1 entered Technical Specification 3.1.2.4 due to the inoperability of the IB centrifugal charging (CV) pump. Technical Specification 3.1.2.4 required the Unit to be placed in Hot Standby within 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br />. The 72 hour8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> time limit would not allow time to perform the necessary pump repairs and testing.

In addition, you identified compensatory measures to include: termination of load following operations, i
evaluation of activities for the. potential to adversely affect unit status, prohibition of newly planned mairtenance on safety-related equipment, termination of enforcement discretion if: there was a significant delay in pump repair, any' of the two sources of borated water became unavailable, lA CV pump became inoperable, any other ECCS equipment became inoperable.

SEP 211993 Therefore, this letter documents our verbal granting on September 17, 1993, of our intention to exercise discretion not to enforce compliance with Technical Specification 3.1.2.4 for the period from September 18,1993, at 5:05 p.m. (CDT) until September 20, 1993, at 5:05 p.m. (CDT). Notwithstanding our granting of enforcement discretion, we will consider enforcement action, as appropriate, for the conditions that led to the need for this exercise of enforcement discretion.
