i Purcose: To provide a progress report on the program and inform the Commission of staff efforts for developing the general framework and specific applications for performance-based regulations.
i Backaround: The staff proposed its plans for elimination of requirements 4 i marginal to safety in SECY-92-263 dated July 24, 1992. The i'
plans included initiating, and subsequently !
institutionalizing, by permanently integrating into the :
1 regulatory process, an ongoing effort to eliminate
} requirements marginal to safety and reduce regulatory 1 j burden. The initial effort included moving toward less l prescriptive and more performance oriented regulations in
) three areas. As part of the rulemaking effort, the staff l proposed plans to develop a framework for a performance-i based regulatory approach and preliminary, specific
- applications to three regulations for discussion at a public
{ workshop.
i The Commission approved, with comments, the staff plan for elimination of requirements marginal to safety in a Staff Requirements Memorandum dated August 26, 1992. The j Commission specifically directed the staff to keep it l informed on the formulation of the framework for developing ;
performance-based regulations and on the staff's plans to l apply proposed procedurcs (PRA technology, safety goals) more comprehensively to the body of regulations. In an earlier Staff Requirements Memorandum dated June 15, 1990, the Commission had provided directives on the use of its Safety Goals for assessing the consistency of regulations and for identifying and possibly eliminating unnecessary !
regulations.
