Pursuant.to the same authorities cited in our response te your original request of April 14, the following is provided by numbered item.

All materials in the. possession of the Office of General Counsel regarding its investigation into the Office of-3 Inspector and Auditor investigation and report of investigation against Messrs. Caldwell and Kelly. This would l'

include, but not limited to, any statements or notes taken during interviews' of witnesses or_ NRC employees, any.

tiansmittals from the-Office of Inspector and Auditor to the Office of General Counsel, and any final or draft report.

No investigation.has been conducted by the-Office of General Counsel.

Therefore, no such

" final or draft report" exists. -Interviews of witnesses and-notes thereof are privileged as attorney work product prepared in anticipation of arbitration.

Any materials.concerning allegations of, or. proven (administrative or otbrwise) improper'or unsatisfactory conduct' on the part.of Mr. Richard L. Bangart, Director, Division of Radiation Safety and Safeguards regarding his i

involvement with the South Texas (Nuclear) Project or with his supervisory role over NRC inspectors at the ST(N)P.

Response

No such allegations exist to our knowledge.

appropriate Office of Investigation reports to detennine what information they would like.
