INITIATION OF RULEMAKING TO AMEND 10 CFR PART 74 TO KATERIAL CONTROL AND ACCOUNTING REQUIREMENTS FOR CENTRIFUGE ENRICHMENT PLANTS i
We have reviewed the proposed amendments to 10 CFR Part 74 and the rulemaking plans, as described in your memorandum dated March 1,1990.
The proposed rulemaking will establish material control and accounting requirements for.
special nuclear material of low strategic significance at comercial centrifuge enrichment plants, and will add a section of requirements to assure that no comercial gas centrifuge machine is used to enrich uranium above a specified r,aximum enrichment.. The material control and accounting requirements will be similar to those currently required under Section'74.31 Congressional action regarding NRC licensing of DOE enrichment facilities is possible.
However, this rulemaking would also be applicable to those facilities.
Therefore, I approve initiation of rulemaking. activity at this time except that the schedule should be compressed to 15 months with a proposed rule to the Commission in July of 1990.
