SECOND TEN YEAR INSERVICE TESTING PROGRAM AND THE GRANTING OF RELIEF FROM TESTING REQUIREMENTS DETERMINED TO BE IMPRACTICAL FOR MILLSTONE, UNIT NO 2 (TAC 75977)

Section 10 CFR 50.55a(g) of the Commission's regulations requires ASME Code Class 1, 2 and 3_ pumps and valves in water-cooled nuclear reactor facilities to meet.the inservice testing requirements set forth in the ASME Boiler and Pressure Vessel Code,Section XI; specifically, Subsection IWP,. Inservice Testing of Pumps in Nuclear Power Plants, and Subsection IWV, inservice Testing of Valves in Nuclear Power Plants. Each facility is required to establish a program for the inservice testing of pumps and valves which is updated every ten years to meet the requirements in the latest ap) roved edition and addenda to Section XI,:of the ASME Code. The program is su)mitted to the NRC for review and approval. The review assures that the program is based on the applicable Code' edition and addenda, that the program covers testing of all appropriate pumps and valves, and that the request for relief meet the requirements of 10 CFR 50.55a.

By letter dated October 30, 1987, supplemented byLletter dated August 26, 1988,

These letters also request relief from testing requirements that you determined to be impractical or would result in hardship or unusual difficulties without a compensating increase in the level of quality-and' safety and propose alternatives to provide an acceptable level of quality ana safety.

The plan was reviewed and evaluated with the technical assistance from EG&G Idaho,Inc.(EG&G). .

We have reviewed the Technical Evaluation Report (TER) prepared by EG&G on request for relief from those testing requirements determined to be impractical 4 to perform at Millstone, Unit No. 2. We have enclosed our Safety Evaluation The TER is enclosed as n attachment to our Safety Evaluation. The SE sets forth our findings with respect to our approval of the requests for relief.

We are granting relief from certain testing requirements and relief from certain testing requirements with conditions as provided in Table 1 of the SE. We have determined that the IST program is acceptable for implementation provided the omissions and '

inconsistencies identified in the SE and in Appendix C of the TER are addressed within six months of the receipt of_this SE.

Program changes that involve additional relief requests or changes to relief requests may not be implemented prior to review and approval by the NRC. New or revised relief requests meeting the positions in Generic letter 89-04, Attachment 1, can be implemented provided the guidance in Generic Letter 89-04, Section D, is followed. Program changes that involve additions or deletions of components from the IST program should be provided to.the NRC.

We have determined that the tests for which relief has been requested and approved, with conditions, are impractical, the alternative methods to be performed will provide adequate assurance of the operational readiness and integrity of the pumps and valves to perform their safet related functions and pursuant to 10 CFR 50.55a(a)(3)(1), (a)(3)(ii) or (g)(6)y(1), is authorized by law and will not endanger life or property or the common defense and security ~and is otherwise in the public interest. In making this determination, we have given due consideration to the burden that could result if these requirements were imposed on your facility.

We, therefore, have determined that the IST Program and.other information '

submitted on October 30, 1987, and August 26, 1988, together with granting of relief with conditions by this letter to be acceptable for the ten-year interval,' December 26, 1985, to December 26, 1995.
