h HEADQUARTERS Licensing Practices and Procedures Course Cardelia Maupin, State Programs, with the assistance of Richard Woodruff, Region II State Agreements Officer, Thomas Rich, NMSS, G. Michael McCann, Region III, Earl Wright, Region II, and Ronald Wascom, Louisiana, conducted an introduction to licensing practices and procedures course on June 11-15, 1990 in Atlanta, Georgia. The course covered a variety of licensing items including academic /research and development licensing, medical licensing, gauges and gas chromotography licensing, well-logging, and industrial radiography licensing. The class consisted of 27 students from States, NRC and the U. S. Air Force.
National Energy Strategy Economic Policy Council Work Group Meeting Harold Denton, Director, Office of Governmental and Public Affairs, and Spiro: Droggitis, State Programs, attended an Economic Policy Council Working Group meeting on the develcpment of the National Energy Strategy (NES)onJune 13, 1990 at Department of Energy Headquarters in Washington, DC. The purpose of the meeting, which was chaired by DOE Secretary Watkins, was to approve a plan to complete analysis of options for the NES, including the organization of interagency working groups to conduct the analysis.
Low-Level Waste Disposal Regulatory Workshop State Programs and the Division of Low Level Waste Manegement &
Decommissioning sponsored a Low-Level Waste Disposal Regulatory Workshop on June 19-21, 1990 in Bethesda, Maryland. The workshop, which was attended by 30 State officials, included status reports on a variety of Federal LLW regulatory initiatives such as the BRC exemptinn policy, mixed waste, manifest rulemaking, Clean Air Act, performance assessment and LLW guidance implementing 10 CFR Part 61. Sessions were held on LLW licensing, characterization and siting issues, Agreement State reviews, the NRC LLW research program and waste form. Workshop presenters included representatives from State Programs, Division of Low-Level Radioactive Waste Management Office of Research, the Environmental Protectior Agency and the States of North Carolina, California and Washington.
Health Physics Society and American Academy of Health Physics Meetings Vandy Miller, Assistant Director, State Agreements Program, and Joel Lubenau, State Programs, attended the 35th Annual Meeting of the Health Physics Society on June 24-28, 1990 in Anaheim, California.
Mr. Miller was the co-chair of a meeting of the Governmental Health Physics Section (Mr. Miller is President-elect of the Sectioh).
Mr. Lubenau participated on a panel at the Section meeting on the General License Concept.

REGION 1 MARYLAND l
Calvert Cliffs Public Meeting A public meeting was held for residents around the Calvert Cliffs Nuclear Power Plant on June 27, 1990 in Solomons, Maryland.
The purpose of the meeting was to discuss the licensee's performance improvement plan and the implementation of the plan.
The staff responded to a small number of questions from the audience, which numbered approximately forty persons.
NEW YORK 1.cgislative Update l
The Governor's Program Bill, No. 317, later Assembly Bill, A-12080, was passed on June 30, 1990 and is expected to be signed by the Governor.
The purpose of A-12080 is to redirect and strengthen the LLW Siting Commission by charging the focus of the Commission to methods selection before site characterization, and by creating a scientific review panel to support the Commission.
The Advisory Commission was redesigned as a Citizens Committee by removing all State agency staff and by requiring public hearings throughout the process to serve as an instrument for public involvement.
1 Senate Bill 8968, which was a ban on implementation of NRC's Below Pegulatcry Concern Policy, did not pass this legislative session and probably will not be acted upon this year.
pet;NSYLVANIA Legislat_ive Update House Bill 1743 was passed (.1 July 1,1990 and was signed by Governor Casey on July 11, 1990.
H-1743, which creates a fee syrtem to cover the costs of the establishment of a low-level radioactive waste disposal facility in Pennsylvania, will permit Pennsylvania to sign the final contract with ChemNuclear for site characterization and eventual development.
ChemNuclear had been chosen to perform these activities last year.
The measure also includes a )rovision which requires that LLW defined as such on January 1,1989, whetler or not such waste has been deregulated as below regulatory concern, must be disposed at a licensed waste facility.

I VERMONT Legislative Update House Bill 534 was signed by Governer Kunin on June 29, 1990.
H-534, among other things, creates a low-level radioactive waste authority to renew efforts to negotiate an agreement for out-of-State disposal, and prepare for in-State siting of a low-level waste disposal facility.
Governor Kunin appointed the three members to the Authority, when the Bill was signed.
The Low-Level Waste Advisory Commission was abolished with passage of this bill. The Authority members are Ms. Hunneman, Chair, and Messers. Paull and Kirk.
6 Senate Bill 244 was signed by Governor Kunin on June 16, 1990. S-244 requires that radioactive waste, including BRC, from licensed activities may only be treated, recycled, stored or disposed of at licensed facilities.
Implementation and enforcement of this State law was not addressed by S-244
_ REGION 11 SOUTH CAROLINA' Catawba Emergency Planning Exercise Richard Woodruff, Region II state Agreements Officer, participated in an emergency planning exercise at the Catawba Nuclear Station on June 7,1990.
in York, South Carolina. Mr. Woodruff served as government liaison on-the site team.
NORTH CAROLINA Brunswick Emergency Plannine Remedial Exercise Robert Trojanowski, Region II Sta'e Liaison Officer, participated in a remedial emergency planning exercise held at the Brunswick Steam Electric Plant on June 22, 1990 in Southport, North Carolina.
Mr. Trojanowski served as a member of the Regional Assistance Committee which evaluated the exercise. The remedial exercise was held to test the licensee's ability to promptly notify and communicate accurate emergency information and State and local ability to respond.
ALABAMA Alabama Radiation Control Program Review Visit Richard Woodruff, Region II State Agreements Officer, conducted a review visit of the Alabama Radiation Control Program on June 27-29, 1990 in Montgomery, Alabama. The purpose of a review visit is to assess the status of the State's program and to assist the State in preparing for a routine review.

o REGION 111 ILLINDIS Radiation Protection Act Illinois House Bill 3506 was introduced into the legislature on April 4, 1990. This Bill:
(1) enacts the Radiation Protection Act of 1990 which provides for regulation by the Illinois Department of Nuclear Safety (IDNS) of the use of radiation sources and radioactive materials; (2) repeals the existing Radiation Protection Act; and (3) provides for repeal of the 1990 Act.on December 31, 2000. This Act has been passed by both Houses of legislature and is awaiting signature by the Governor.
Resident Engineer Legislation IDNS notified Region 111 that legislation establishing a State resident En ineer pilot program in Illinois has passed both Houses of the le islature and has been sent to the Governor for signature. The le islation, according to IDNS, has been modified to allow no more than two State Resident Engineers to be placed in Illinois for a period of two years. The Clinton Power Station is exempted from the pilot program, in addition, at the end of one year, IDNS must prepare a report to the legislature which justifies the program based upon demonstrated benefits to reactor safety.
Low-Level Waste Senate Bill 1761 was signed into law by Governor Thompson on June 28, 1990.
The law establishes a Low-Level Radioactive Waste Disposal Facility Siting Commission consisting of three members appointed by the Governor with the consent of the Senate. The three members are Seynour Simon, former Illinois Supreme Court Justice, Carolyn Raffensperger, Sierra Club, and William Hall, Civil Engineer.
All three have been confirmed by the Senate.
The duty of the CommOsion will be to evaluate the safety and suitability of any site proposed by the IDNS Director for the location of a permanent f acility for the disposal of low-level radioactive waste, and to determine if the proposed site meets all the State requirements.
BRC Resolution The Illinois House of Representatives adopted a resolution on June 19, 1990 which opposes the deregulation of any radioactive waste, urges Congress to repeal Section 10 of the low-Level Radioactive Waste Policy Amendments Act and urges NRC and EPA to refrain from any activity to deregulate.
MICHIGAN Low-Level Waste The States of Washington and Nevada wrote letters dated June 28, 1990 to Michigan Governor Blanchard stating that unless. problems relating to 4
r Michigen's siting of a low-level waste disposal facility are rectified, access to the Beatty and Hanford disposal sites will be denied. Michigan was given until 60 days after their legislature returns to session in September 1990 to either have selected sites in Michigan for detailed site cheracterization or have passed legislation revising their siting criteria. The ban would not apply to other States in the Midwest Compact. South Carolina issued a similar letter on July 12, 1990.

The Michigan Low-Level Radioactive Waste Authority has recently eliminated the final site from consideration for failing to meet the State's siting criteria concerning water resource protection.
Future activity in Michigan will be to determine if, in f act, any site can be found to meet the State's siting criteria.
MISSOURI TRUMP-S Project Governor Ashcroft has received a num' er of letters from constituents o
opposing the TRUMP-S research project at the University of Missouri. The University received two license amendments to conduct research on removing long-lived radioactive materiais from spent nuclear fuel. The ASLB has issued a Memorandum and Order on a request for hearing and stay pending hearing, admitting several parties and their areas of concern and deferring action on the stay request.
OH10 MOUs On June 13, 1990, Roland Lickus, Chief, State and Government Affairs, attended a meeting of a Utility Radiological Safety Board subcommittee dealing with MOUs with the NRC. The su) committee was informed that the NRC no longer supported generic or umbrella MOUs but that we were prepared to negotiate specific inspection accompaniment or participation agreements with the State of Ohio.
REGION IV LOUISIANA FEMA - USDA Emeroen g Planning Workshop Charles Hackney, Region IV state Liaison Officer, attended an ingestion pathway workshop on June 26-29,1990 in Baton Rouge, Louisiana. The workshop was sponsored by the Federal Emergency Management Agency and the U.S. Department of Agriculture. The subject of the workshop was protecting the public and its food supply in the event of offsite releases as a result of an accident at a nuclear facility. Many of the representatives were from the agriculture community and had not been exposed to the full federal emergency response organization concept.

WYOMING Termination of State's Radiation Control Section Julius Haes, Wyoming State Liaison Officer (SLO), notified Region IV that the State had terminated funds su) porting the radiation control section in Wyoming.
Previous duties of tie radiation control representatives were:
State Liaison Officer, radiological emergency response, radioactive fuel shipments (notification), and State inspector.
The duties of the individual have been distributed to other State agencies.
P.egion IV has not received any official transmittal from the State detailing any new assignments.
RAJJO Idaho Fediation Control Program Review Visit Howard J. Faulker, Region IV conducted a review visit of the Idaho radiatico control program on June 25-26, 1990, in Boise, Idaho. The i
purpose of a review visit is to assess the status of the State's program and to assist the State in preparing for a routine program review. The Idaho program was recently lef t with a serious lack of staff when an experienced technical staff member resigned from the program. Since Idaho was unable to provide any assurance concerning a replacement for this position or any method to address the workload for agreement materials, followup action by NRC's State Agreements staff is necessary.
HEBRASKA Nebraska Radiation Control Program Review Robert J. Doda, Region IV State Agreements Officer, was leader of a team review of the Nebraska radiation control program on June 11-15, 1990, in Lincoln, Nebraska. An exit meeting was held with the Directors and key staff representatives of Nebraska's Department of Health and Department 6

of Environmental Control on June 15, 1990. Due to a number of serious problems including regulations, staffing, and divisions of authority, the steff was unable to make a finding of adequacy and compatibility for the

Nebraska program. Even though the State is taking immediate action to correct most program deficiencies, a followup review of Nebraska's program is being planned.
REGION Y ARIZONIA Arizona Radiat'.on Contt01 Program Review Jack Hornor, Region V 5 tate Agreements Officer, with the assistance from John McGrath, Region I State Agreements Officer, conducted a review of the Arizona Radiaticn Control Program from June 4-15, 1990 in Phoenix, Arizona.
Preliminary findings will be reviewed by Regional and Headquarters offices and the results of the review will be confirmed in a letter to the State.
CAllFORNIA Rocketdyne Interagency Working Group Meeting Dean Kunihiro, Region V State Liaison Officer, participated in a Rocketdyne Interagency Working Group meeting on June 25, 1990 in Simi Valley, California, Concerns were again raised by the public participants that the NRC's radiation protection standards were outdated.
