NRR OFFICE LETTER NO. 101, REVISION 6 DELEGATION OF SIGNATURE AUTHORITY l

PURPOSE Revision 6 to NRR Office Letter No. 101 redelegates signature authority as provided for in NRC Manual Chapter 0123. Section 0123 05, Office of Nuclear ReactorRegulation(NRR). Revision 6 deletes reference to the Associate Director for Special Projects (ADSP), and adds authority pertaining to.

Confirmatory Action Letters and the NRC's Internal Control Comittee. Revision 6 also consists of some misc 611aneous~ updates and clarifications.

Revision 6 supersedes the Delegation of Signature Authority dated January 13,1989(Revision 5).

OBJECTIVES To authorize signature authority for various documents and correspondence issued by NRR to ensure effective and efficient implementation of the assigned responsibilities.

RESPONSIBILITIES AND AUTHORITIES Redelegation of responsibilities and authorities is delineated in the enclosure to this office letter revision.

NRR associate directors and the staff director are expected to issue I

procedures reflecting internal NRR signature authorities that are consistent with the delegation of authority reflected in the enclosure to this revision and the responsibilities assigned, if appropriate.

CONCURRENCES l

1.

An. individual's concurrence does not mean that he or she agrees with the structure or every detail of the document.

Concurrence indicates L

agreement with the overall approach, objective, and technical content, along with the belief that the document does not or will not adversely impact or conflict with other NRC programs or policies.

2.

Concurrence does not indicate administrative :orrectness except to the extent that the responsible NRR manager hcids his or her staff accountable for the administrative correctness of the document.

Concurrence chains need not be lengthy and should be limited to those individuals who have a need to agree in the proposed action from a policy, technical, or legal standpoint.

When changes are made to documents which have previous concurrences, the package should be returned to the originator and the appropriate supervisor for their reconcurrence.

If the originator does not agree with the changes or some compromise,'the originator may choose to rescind his or her concurrence. This procedure for reconcurrences. policy denotes the minimally acceptable Certain instances may exist where additional reconcurrences by individuals other than the originator would be prudent. Sound judgment should be exercised to ensure t1at all concurrences remain unaffected.

The management level within NRR having the action authority for the subject matter is responsible for deciding which other NRC/NRR organizations and levels within those organizations should concur in the action being taken. Concurrence from other divisions within NRR should be at the lowest management level that can speak authoritatively on a

Branch chief concurrence would be appropriate on issues involving novel technical content multi-site impact or minor policy questions,andotheriss,uesoflessersignIficance, b.

Assistant director or division director concurrence normally would be appropriateif(1)significantorcompletetechnicalissuesare substantia (1policyissuesareinvolved,2) significant programmatic impacts are likely, involved in these cases, the appropriate associate director should be notified.

The Director NRR, should be informed before any action is taken that is likely to result in changes to plant operating status.

The cognizant division director is responsible for all actions within his or her functional area, whether or not concurrence is obtained from any other NRC/NRR organization. The decision-making authority rests with the cognizant division director. Therefore, inability to obtain concurrence from another organization does not relieve the division director of the responsibility to meet schedules.

The Director, NRR, holds the cognizant division director responsible for the technical and administrative accuracy of all proposals prepared for the Director, NRR, or higher agency management.

Concurrence on controlled correspondence is to be obtained in accordance with NRR Office Letter 103, as revised.

Review concurrence of the Office of General Counsel (OGC) is normally sought only on controlled documents that involve (1) legal interpretations of the regulations, (2) correspondence from intervenors or relating to an active proceeding, and g
