'Ihis is to infom you that the cocinission (with all Om nissioners agreeing) has approvod y ur rh.adation for the developnent of a proposed rule on fitness for duty for Category I facilities ard shipments. 'Ihe rulemakiTg should be designed to ensure fitness for duty of sployees (1) kho have direct access to large quantities of special nuclear material (2) kho are directly responsible for protection of the material; ard (3) kho transport the material. 'Ibe rule should be developed ard issued in final fem within 2 years.

'Ihe Ctanission has disapproved the prmM policy statement which would have addressed the need for fitness for duty programs for other imC licensee perrainel.

In lieu of such a policy statement, the comission (with Chairman carr ard himioners Curtiss ard Remick agreeing) directs the staff to develop an appropriate infomation notice khich would infom these lie asees of the Drug-Pree Workplace Act ard generally describe the NRC's considerations in prcmulgating the fitness for duty rule for licensees authorized to construct or operate nuclear power reactors. Ctanissioner Rogers, while not objectirg to the information notice approach, would have preferred the policy statement approach, ccanissioner Remick stated he was not so concerned with the form of ImC's notice as with getting the message out to the licensees.
