Dear Chairman Zech:

Enclosed is'a copy of a Resolution of the Forked River Civic Association of May 7, 1990, signed ~by the Association President Raymond Taylor.

- This Resolution and copies of all the attached related

documents are pertaining to an-ongoing. dispute in Lacey.

y Township concerning severe shoaling of the. south branch of the Forked-River and adjacent lagoons, jq To'synopsize as briefly as possible, the south branch of o

the~ Forked River and nearby. lagoons are shoaled severely.

i Jersey Central Power & Light has attempted to dredge the l

waterway and has indicated its willingness to also dredge. areas i

of nearby lagoons which are also badly shoaled.

l This matter has been involved in the Courts for sometime, l

and the Developer of the area owns-most of the riparian rights.

Superior Court Judge William H.

Huber has ruled that JCP&L must' pay the Developer to dredge areas of his privately

)

riparian owned lands.-

Mr. Taylor and the members of the Forked River Civic Association are appealing to us for any possible assistan7e to I

try to ameliorate these circumstances.

The water front areas of-these lagoons have become diminished in value and residents are unable to use them for boating and other recreational activities because of their shallowness.

i Perhaps of a more urgent concern, the shoaling in the-south branch of the Forked. River has greatly reduced the value of water and raises strong concerns among area residents that-j the' Oyster Creek-Facility has the appropriate volume of water which is necessary-for the cooling process.

Accordingly, we would be most appreciative if you would i

provide personal attention in reviewing these particuler and complex problems involving the Oyster Creek Nuclear Gcan'ating 1

Station.

We would urge your Agency to do everything ptenible to try to resolve this problem and to accomplish this dredging project for both the safety.and quality of life of-the.

residents of the Forked River Civic Association.

We appreciate your attention to this' problem and would welcome your assistance in any possible way.

We do look forward to hearing L

from you in the near future in order that we may provide your-findings to the Forked River Civic Association.
