The Nuclear Regulatory Commission (NRC) received the enclosed Federal Emer-gency Management Agency (FEMA) letter dated August 2 1982, which refers to deficiencies in the state of emergency preparedness around your reactor site at the Indian Point Nuclear Power Station. Enclosed with the FEMA letter is their report dated July 30, 1982, entitled " Interim Findings on the Adequacy of Radiological Emergency Response Preparation of State and Local Governments at the Indian Point Nuclear Power Station". This report contains the findings by FEMA during their observation of the Emergency Preparedness Exercise on March 3, 1982, and their assessment of the ability of the State of New York and the Counties of Westchester, Putnam, Rockland and Orange to implement i

their Radiological Emergency Plans. We consider the offsite deficiencies identified to a'p ply equally to Units 2 and 3.

The major concerns identified by FEMA as significant deficiencies (capability weak) relate to the following planning standards of 10 CFR 50.47(b):

• Notification Methods and Procedures, (Planning Standard No. 5);

• Public Education and Information, (Planning Standard No. 7);

• Protective Response, (Planning Standard No. 10);

• Radiological Exposure Control, (Planning Standard No. 11);

• Responsibility for the Planning Effort, (Planning Standard No. 16).

We are of the view that the significant deficiencies identified by FEMA and referred to above, must be remedied in order for us to conclude that appropri-ate protective actions can and will be taken in the event of a radiological emergency at your facility.

Consequently, pursuant to 10 CFR 50.54(s)(2)(ii) you are hereby notified that, should the significant deficiencies identified by FEMA in their August 2, 1982 letter not be remedied within 120 days of the date of this letter, the NRC will determine whether your reactor shall be shut down until such deficiencies are remedied or whether other enforcement action is appropriate.

Further, you are to submit a written statement to this office within 30 days of the date of this letter, describing plans for correcting each of the significant deficiencies identified by FEMA. This request affects fewer than 0FFICIAL RECORD COPY 8208100030 820803 PDR ADOCK 05000247 F PDR
