Appendix NOTICE OF VIOLATION I

Wisconsin Publice Service License No. DPR-43 Corporation As a result of the inspection conducted on May 1-31, 1982, and in accordance with the NRC Enforcement Policy, 47 FR 9987 (March 9, 1982), the following violation was identified:

Section 55.33 of 10 CFR Part 55 requires that each licensed individual demon-strate his continued competence every two years in order for his license to be renewed. 10 CFR Part 55 Appendix A states, in part, " Competence may be demonstrated, in lieu of reexamination, by satisfactory completion of a re-qualification program which has been reviewed and approved by the Commission".

The Commission approved Kewaunee Operator Requalification Program, Section 7.0, states in part, "the annual examination is to be given in its entirety to all licensed persons during a single, consecutive, fourteen-day period."

Contrary to the above, the 1980 annual examination was not given in its entirety '

within a single, consecutive, fourteen-day period. In several instances the results of an examination given following health physics lectures, several months prior to the annual requalification examination, were used in compil-ation of the annual examination grades.

This is a Severity Level V violation (Supplement I).

The inspection showed that action had been taken to correct the identified item of noncompliance and to prevent recurrence. Consequently, no reply to this item of noncompliance is required and we have no further questions regarding this matter.
