SUBJECT:
T!11-1 RESTART CERTIFICATION PURPOSE:
To infom the Conaission of the staff's plan for certifying completion of restart requirenents on TMI-1 in response to Chairman Palladino's memorandum to W. J. Dircks dated itarch 16, 1982 DISCUSSIGH: The Conmission's August 9,1979 Order on TitI-l specified among things that, following issuance of a Licensing Board decision authorizing resumption of operation following completion of certain short tem actions and a finding by the Board that the Licensee is naking reasonable progress toward completion of certain long tern actions, the staff shall certify to the Comnission that those short tem actions have been completed to its satisfaction.
With respect to the short tern requirenents of the August 9,1979 Order and those additional short tem requirements inposed by the Board, the staf f has inplemented a plan for certification of those restart requirements. A listing of all restart requirements has been prepared in the form of a detailed inspection natrix which Region I inspectors are using as a basis for their inspections.
All short tero requireuents will be verified complete by Region I inspectors ani/or the KRR staff with findings documented in an in-spectinn report, Safety Evaluation Report or letter as appropriate.
Region I is providing rr. ports to NRR on a bi-nonthly basis docu-menting the status of remaining itens. The attached listing re-flects the present status of bearing related restart requirements.
At the time of licensee completion and staff verification that these short tem iters are complete, the Director of NRR will so

P P With respect to the long tern requirerents of the August 9, 1979 Order, the Board found that the long tern actions reconnended by the Director of liuclear Reactor Regulation in the August 9,1979 Order were sufficient to provide reasonable assurance that TitI-l can be operated safely in the long tem.
In addition, the 00ard concluded "that the Licensee has deninstrated reasonable progress toward the successful conpletion of these long tem actions" (Partial Initial Decision (PID),of 12/14/81, para.1223). With respect to two long tem
)
actions, i.e., abnormal transients operating guidelines ( ATOG),
v5fch is the licensee's response to Order Iten 2.1.9 (PID. s 721),
and prevention of feedwater isolation due to failure in rupture detection systou, which is a Board imposed requircrent (PID. s 1064),
the Board specifically charged the staff with revicuing these itens to detemine if the licensee has made reasonable progress toward their cogletion prior to restart. A reasonable progress deterafnation by the staff on these tuo items will te included in t%c staff's certification to the Connission when restart require-ments have been completed. Following a determination that reason-
.able progress has been nade on these two itens, the requirenent of the Connission's August 9,1979 Drder with respect to long tern requirenents will be satisfied.
The Connission should note, hot <ever, that the long tem Order requireents have since besone tiUREG-0737 requirements which have also been imposed on other operating reactors. In addition, the CUPJG-0737 Operating Reactor inclemntation dates for many of these items has passed.
In CLI-81-3, M HRC 291 at 295-296 (1981), the
.Ces:nissfon ruled on a request by the licensee that T!11-1 be dealt rith.regarding NUREG-0737 actions consistent with the treatnent accorded operrtng reactors. There the Connission indicated that it retained its flexibility to consider on a case-by-case basis developments affecting the ability of the licensee to comply with due dates for sedh requirerents as HUREG-0737 actions proposed to be inpased by the Cocnission.
In keeping with the manner in which IlVREU-0737 requfrenents are being dealt on other reactors with opt ratirp licenses the staff intends to negotiate plant specific

l The commitments agreed to between the licensee and the staf f will of course be consistent with Board conditions recommended in the Board's PIDs. It is expected that nost of the long tem Order requirements will be conplete prior to restart.
The present status of the long tem Order requirements is shown on pages 6 and 7 of the attached table.
CERTIFICATION SCHEDULE At the present tine, as indicated in the attached table, there are nunerous items renaining to be conpleted. Many nodifications are in the final stages of construction and testing. There are also incomplete work itens; those are modifications essentially completed but with some renaining effort that can be acco-'plished within the next two nonths.
As the Commission is aware, repair of the stean generators is a cajor impedinent to plant readiness for restart. Assuning no licensing delays, it is estimated that the plant could be ready for criticality in December 19P2.
It appears that the licensee is endeavoring to conplete restart requircoents by Septenber 1982, but some of the restart requirements involve testing which requires the plant to be either hot or at low power (e.g., low power natural circulation testing). Assuming the licensee actively pursues completion of remaining short term items, the staff presently anticipates completing certification cf all items not requiring a change in plant conditions e.g.,
heatup, and/or low power operation for their completion, by Novenber 1982. For those itens requiring changes in plant conditions for their conpletion, the staff intends to recormend to the Connission that such items becoac a condition of the license, or the Order which would lift suspension of the license.
