In its Special Prehearing Conference Order dated June 1, 1982, the Licensing Board in the captioned proceeding, inter i

alia, directed the Applicant to advise the Board within 30 days of the service of this Order of the proposed schedule for the construction of the Point Pleasant intake and asso-

ciated pump station and the Bradshaw Reservoir. A copy of my j letter to the Board transmitting this schedule is attached for your information.

f The Board also directed that the NRC Staff, the Applicant,

and Del-AWARE jointly submit a schedule for the filing of l testimony and litigation for the " water" contentions granted to Del-AWARE. As you know, we have noted our objections to the Board's Order on this point. However, under the Board's

! Order, the three involved parties are all obligated to develop a schedule on the assumption that these four cententions remain as admitted.

NWRA advises the Applicant that, in order to minimize the adverse effects on the aquatic environment from con-struction activities, it is required by DRBC to conduct the

initial phases of its construction work during the winter months. Accordingly, with NWRA's construction scheduled to

! commence December 15, 1982, the attached litigation schedule is designed to be completed prior to that date.
