IV.

CONCLUSION l

On both procedural and substantive grounds, the Cc~.-enuc al th ha s failed to justify the imposition of a license condition concerning the availabilitv of dosimetry for distr.i-t bution off-site to emergency workers.

Such a license condition f

doec not fall within the scope of L:

'ni~ted contentions and

[

therefore was beyond the ASLE's power to impose.

The j

l Cor nonwealth has the obligation to sup.oly dosimetrv and has not P

rhoun any reacon it cannot do co.

i The ultimate issue for the Appeal Board to decide is whether the regulatory requirrments of 10 C.F.R.

S 50.47 have acen met.

Applicants respectfully submi: that the record l

I supports a finding cf a rcasonable assurance that adequate protective measures can and will be t v. e., in the event of a radiological emergency.
