Systematic Assessment of Licensee Performance Program ,for Your Farley Plant (Docket Nos. 50-348 and 50-364)

The Nuclear Regulatory Conmission (NRC) has completed the annual evaluation of the performance of your reactor facilities. As you are aware, this evaluation program, the Systematic Assessment of Licensee Performance (SALP), involves:

1. An assessment of facility performance by the NRC staff;
2. The issuance of the staff's findings in the form of a final report, the SALP Board Report;
3. A meeting with the senior staff of your company to present and discuss the Board's assessment;
4. Your response, if any, to the SALP Board's assessment; and
5. The approval and public distribution, resolving connents if appropriate, of the SALP Report by the Regional Administration.

As Regional Administrator, and in accordance with NRC policy I have reviewed the SALP Board Report and your connents on that report. Based on this review, the SALP Board Report is approved with the following observations:

1. In your letter of May 7,1982, responding to the findings of the SALP Board, you concluded that Section IV.A.G.a. of the SALP Board Report was incorrect in stating that the " licensee failed to submit a timely request for exemption for meeting Appendix R." I have reviewed this occurrence and hereby recognize that your company filed a detailed plan and schedule for compliance within the required 30-day p6riod.

However, your letter did not request an exemption from our regulations.

It is also noted that, subsequently, you requested an exemption which a was later granted by the NRC. Although this item was not cited as a noncompliance and did not involve a significant nuclear safety matter, the NRC position remains as stated in the SALP Board Report.

JUN 1 8 1982 As Regional Administrator, the SALP Board Report is approved without modification.

It is my view that Alabama Power Company's management has been attentive to and involved in matters of nuclear safety. Further, it is evident from the SALP Board Report that Alabama Power Company's resources have adequately effected satisfactory performar;ce in operational safety and plant construction. I wish to-recognize, as a matter of importance, that the Farley facility has reached a high level of performance in the critical areas of plant operations, radiation protection, and quality assurance.

In accordance with 10CFR2.790(a), a copy of this letter; the letter of April 22, 1982, from R. C. Lewis, SALP Board Chairman, and the enclosed SALP Board Report; and the letter of May 7,1982, from F. L. Clayton, Jr. responding toi the SALP Board Report will be placed in the NRC's Public Document Room unless you notify this office, by telephone, within ten days of the date of this letter and submit written application to withhold information contained therein within thirty days of the date of this letter. Such application must be consistent with the requirements of 2.790(b)(1).

No reply to this letter is required; however, should you have any questions concerning these matters, we will be pleased to meet with you.
