April 6,1982 to the Connissioners, in which yod aqueste efiptifrv in the startup of the Big rock Point Plant until the " reactor an be safely offloaded in the event of an erergency..." Your petition has been treated under 10 CFR Section 2.206 of the Comission's regulations.
It was referred to the URC Staff for disposition on April 12, 1982.
On April 10, 1982, prior to the staff's receipt of your petition, the Big Rock Point facility started up af ter the 1982 refueling outage. Your petition, which irplicitly requested immediate action to prevent the startun, was consequently treated as a request to suspend continued plant operation. For the reasons stated in the enclosed decision, I decline to take action on your request.
A copy of this determination will be placed in the Commission's Public Document Roon at 1717 H Street, fl. W., Washington, D. C. 20555 and at the Local Public Docunent Roon located at 107 Clinton Street, Charlevoix, Michigan 49720.
The decision will also be filed with the Secretary of the Connission for its review in accordance with 10 CFR 2.206(c) of P.e Comission's regulations.
As provided for by this regulation, the decision will constitute the final action of the Connission tuenty-five (25) days af ter the date of issuance of the decision unless the Commission, on its own notion, institutes a review of the decision within that time.

Second, spent fuel could be shipped to storage facilities operated by General Electric or the Department of Energy. Third, spent fuel could be stored on-site in approved shipping casks.
For the reasons discussed above, I decline to take any immediate action to offect a shutdown of the Big Rock Plant.
Final action on your petition will be taken in a reasonable time. Enclosed for your information is a copy of the notice which is being filed for publication at the Office of the Federal Register.

For the reasons discussed above, I conclude that full core off-load capability does not have to be provided in the Big Rock Point spent fuel pool to operate the plant in a safe manner. And therefore, I decline to take any action to ef fect a shutdown of the Big Rock Plant.
