Consolidated Edison Company of New York, Inc. (" Con Edison"), licensee of Indian Point Unit No. 2, hereby moves the l Atomic Safety and Licensing Board (" Board"), pursuant to 10 CFR Part 2 and the Board's prior Memorandum and Order of April 23, 1982 (the " April 23 order"), to issue an order striking the direct testimony of intervenor witnesses Brian Palenik and Jan Beyea, witnesses for intervenors herein. Licensees seek such an Order on the grounds that to date, intervenors have not served upon Con Edison the testimony of these two key witnesses, despite the provicion of the Board's April 23 Order requiring them to do so by June 7.

After the second special prehearing conference, the Board issued its April 23 Order directing the filing of the testi-mony on matters arising under Commission Questions 3 and 4 by June 7, 1982. Intervenors served a portion of its testimony on Con Edison by mail on June 7, 1982. The index to the intervenor testimony referred to the testimony of Mr. Palenik and Dr. Beyea as Witness Number 1, but no such testimony was served. In addition, no certificate of service accompanied intervenors' testimony, in violation of 10 CPR S 2.701(b),* thus intervenors

  • On December 21, 1981, the Board issued an order, Memorandum and Order (Practice and Procedures) mandating compliance in all future filings of the rules set forth in 10 CFR Part 2.

10 CFR S 2.701(b) provides:

All documents offered for filing shall be accompan-ied by proof of service upon all parties to the pro-ceeding or their attorneys of record as required by law or by rule or order of the Commission. . .

Counsel for The Union of Concerned Scientists /New York Public Interest Research Group ("UCS/NYPIRG")was called by counsel {

for con Edison on Thursday, June 10, concerning the absence of any certificate of service or testimony of the two witnesses.

UCS/NYPIRG counsel informed Con Edison that someone would attend to the situation. To date, June 14, Con Edison still has not been served with either a certificate of service or the Palenik/Beyea l testimony.

The Board's April 23, 1982 Order required timely service of testimony so that parties could adequately prepare for: a.)

the submission of cross-examination schedules due on June 14; b.)

the prehearing conference on June 16-17; and, c.) the cross-exami-nation of witnesses commencing on June 22. Unfortunately, the prehearing conference is a mere three days away and Con Edison has not yet been served with all of the testimony of intervenors' witnesses, despite a request to opposing counsel and assurances that service would be perfected. The lack of service of this testimony has hampered the preparation of Con Edison's cross-exami-nation plans.

WHEREFORE, licensees respectfully request that the Board issue an order striking the testimony of intervenor witnesses Palenik and Beyea for failure to comply with 10 CFR S 2.701(b) i
