The Staff has, this date, filed "NRC Staff's Response to Motion of Duke Power Company to Withdraw Application Without Prejudice." Although not explicitly stated therein, the Staff wishes to call your attention to the following statement that appears in an earlier pleading filed by the Staff in this proceeding:
The Staff wishes to note that it is aware of no reason why the application may not be dismissed. The Staff has detennined that no LWA has been issued in this pro-ceeding and that no site preparation activities have cccurred. Accordingly, the Staff has determined that no site redress action is required.
